HomeMy WebLinkAboutORD 94-35 ORDINANCE NO. 9 V_ 0 ENTITLED AN ORDINANCE AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT; AMENDING DEFINITIONS, WASTE DISPOSAL REGULATIONS, AND LANDFILL DISPOSALFEES;PROVIDINGFOR SEVERABILITY;PROVIDINGFOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT Section 28-20.1 of the Code of Ordinances of the City of Beaumont be and the same is hereby amended to amend the definition of "hazardous refuse" and "industrial waste" to read as follows: Section 28-20.1 Hazardous refuse means materials such as poison, acids, caustics, chemical, infected materials, offal, fecal matter, and explosives or as defined by the Texas Natural Resource Conservation Commission. Industrial waste means all waste, including solids, semisolids, sludges and liquids, created by factories, processing plants or other manufacturing enterprises or as defined by the Texas Natural Resource Conservation Commission. Section 2. Section 28-23.1(b) of the Code of Ordinances of the City of Beaumont is hereby amended to read as follows: Section 28-23.1 (b) Only waste produced and collected within the city limits of the City of Beaumont may be disposed of in the city landfill. Section 3. Section 28-24.4(a)(1) and 28-24.4(b)(1) and (2) be and the same are hereby amended to 0 - 9�/- 7-1�2 - W read as follows: Section 28-24.4(a)(1) All persons of the City may dispose of residential waste from their residence upon presenting proof of residency. Section 28-24.4(b) Disposal fees shall be based on collection of refuse from inside the city limits. The fee shall be assessed to the nearest cubic yard of refuse disposed. (1) Compacted refuse $6.00/cy (2) Noncompacted refuse $5.25/cy Section 4. Section 28-44 of the Code of Ordinances be and the same is hereby amended to add two new sections 28-44 (8) and (9) to read as follows: Section 28-44 (8) (8) Liquid waste Section 28-44 (9) (9) Other waste prohibited from landfill disposal by the Solid Waste Act Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 7. That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of the City of Beaumont, Texas.
