HomeMy WebLinkAboutORD 92-67 ORDINANCE NO. � ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 1200 East Drive 370 E. LaSalle 325 E. Lucas (Shed) 355 Flowers (Garage) 325 E. Lucas 1640 Tilson (Front) 1518 Cable 1640 Tilson (Shed) 2085 Dexter 1640 Tilson (Garage Apt) 1180 Magnolia (Commercial) 2675 Southerland 1165 Magnolia 2550 Southerland 1167 Magnolia 3795 Goliad 1165 Magnolia (Shed in Rear) 1660 Prairie 1197 Miller 431 San Jacinto 837-39 Jefferson (Rear) 1305 Crockett (Commercial) 540-40 1/2 Schwarner 1365-95 Crockett (Commercial) 355 Flowers each to be a public nuisance in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owners or owners of the following -Li')- L"-,l q-t -q '2- buildings either demolish or repair said structures within thirty (30) days of the effective date of this ordinance: 1200 East Drive 370 E. LaSalle If such action is not taken, request shall be made that the City Council authorize appropriate City officials to demolish and remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 325 E. Lucas (Shed) 325 E. Lucas 1518 Cable 2085 Dexter 1190 Magnolia (Commercial) 1165 Magnolia 1167 Magnolia 1165 Magnolia (Shed in Rear) 1197 Miller 837-39 Jefferson (Rear) 540-40 1/2 Schwarner 355 Flowers 355 Flowers (Garage) 1640 Tilson (Front) 1640 Tilson (Shed) 1640 Tilson (Garage Apt) 2675 Southerland 2550 Southerland 3795 Goliad 1660 Prairie 431 San Jacinto 1305 Crockett (Commercial) 1365-95 Crockett (Commercial) Section 4. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on account of the owners thereof and such expense of demolition and removal h. shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were theretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: 4110 Brandon 434-36 E. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
