HomeMy WebLinkAboutORD 92-75 ORDINANCE NO. ga"7S ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 2205 Avenue A 1146 Forrest 1860 Sarah 1156 Forrest 3075 S. 5th 1741 Herring Alley 2290 Neches (Commercial) 1970 Brooklyn 795 Pollard 1599 Madison 450 Manning 1427 Corley (Rear) 2760 Tannis 1425 Corley (Front) 1415 McFaddin 2037 Corley 1405 McFaddin 2910 Hebert (Commercial) 1595 Avenue A 635 Mary 3088 W. Brenham 665 Mary 1405 Cable 1901 Park 1064 Long 2290 Neches (Garage) 1324 Harrison (Garage) 1960 Cable 1901 Park (Rear) each to be a public nuisance in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owners or owners of the following 111A— IYS �1 �V Z ° buildings either demolish or repair said structures within thirty (30) days of the effective date of this ordinance: 3075 S. 5th 2205 Avenue A 1860 Sarah 1146 Forrest 1156 Forrest If such action is not taken, request shall be made that the City Council authorize appropriate City officials to demolish and remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 1741 Herring Alley 1970 Brooklyn 1599 Madison 1427 Corley (Rear) 1425 Corley (Front) 2037 Corley 2910 Hebert (Commercial) 635 Mary 665 Mary 1901 Park 1901 Park (Rear) 2290 Neches (Garage) 2290 Neches (Commercial) 795 Pollard 450 Manning 2760 Tannis 1415 McFaddin 1405 McFaddin 1595 Avenue A 3088 W. Brenham 1405 Cable 1960 Cable 1064 Long 1324 Harrison (Garage) Section 4. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were theretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: 1108 Ashley 3645 Lorilee 1148 Ashley 3670 Lorilee 1156 Ashley 3940 Lydia 1162 Ashley 3390 St. Helena (Shed) 2226 Beatrice 3230 St. James 3670 Edmonds 4235-39 Sullivan 1625 Gilbert 3070 Terrell 2845 Houston 2424 Texas 1395 Isla 5160 Wilshire Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
