HomeMy WebLinkAboutORD 91-94 ORDINANCE NO. 9 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 1480 E. Gill 1576 Pipkin (Garage) 1520 E. Gill 2210 Potts 1524 E. Gill 2195 Southerland 1550 E. Gill 1560 E. Gill 3025 Glenwood 1570 E. Gill 2195 Terrell (Shed) 1740 Levy 1635 Bean Court 2329 E. Lucas 1655 Bean Court 2145 Primrose 1565 LaSalle 2940 16th (Shed) 1575 LaSalle 2460 N. 9th 1615 LaSalle 1505 N. 7th (Comm) 4034 Magnolia 2095 Magnolia 4026 Magnolia 1106 Long 4022 Magnolia 1139 Ashley 4012 Magnolia 1353-57 Louisiana 1640 E. Gill 1054 Harrison 1650 E. Gill 63-65 Minor 915 Schwarner 3890 Hollywood (Comm) 965 Grant 150 Orange 1860 Irving (Comm) 160 Orange 4211 Highland (Garage Apt) 170 Orange 1256 Harriot each to be a public nuisance in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owners or owners of the following buildings either demolish or repair said structures within thirty (30) days of the effective date of this ordinance: 1256 Harriot 2195 Southerland 965 Grant 1480 E. Gill 1520 E. Gill 1524 E. Gill 1550 E. Gill 1560 E. Gill 1570 E. Gill 1635 Bean Court 1655 Bean Court 1565 LaSalle 1575 LaSalle 1615 LaSalle 4034 Magnolia 4026 Magnolia 4022 Magnolia 4012 Magnolia 1640 E. Gill 1650 E. Gill 1576 Pipkin (Garage) 1740 Levy If such action is not taken, request shall be made that the City Council authorize appropriate City officials to demolish and remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 915 Schwarner 1860 Irving (Comm) 4211 Highland (Garage Apt) 2210 Potts 2195 Terrell (Shed) 3025 Glenwood 2940 16th (Shed) 2329 E. Lucas 1505 N. 7th (Comm) 2145 Primrose 1106 Long 2460 N. 9th 1353-57 Louisiana 2095 Magnolia 63-65 Minor 1139 Ashley 150 Orange 1054 Harrison 170 Orange 3890 Hollywood (Comm) 1054 Harrison 160 Orange Section 4. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were theretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: 2795 Atlanta 1260 LaSalle 2599 Cable 1788 Laurel 2599 Cable (Rear) 1709 McFaddin 1345 Collis 5380 Nelkin Ln. 1345 Collis (Garage) 3162 Pine 3470 S.11th 1308 Victoria 3470 S.11th (Rear) 2543 Wall (Garage Apt) 2710 Franklin 702 College (Comm) 2408 Goliad 734 College (Comm) 1145 Harriot (Comm) 746 College 2410 Hegele (Comm) 764 College 1010 Sherman 764-A College (Rear) 2215 Pear Section 6. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 7. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
