HomeMy WebLinkAboutORD 92-19 ORDINANCE NO. —/9 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO ALLOW A BEAUTY SALON AT 2225 HAZEL AVENUE, BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the Planning and Zoning Commission of the City of Beaumont considered the issuance of a specific use permit to allow a beauty salon at 2225 Hazel Avenue, Beaumont, Jefferson County, Texas, to Alesha E. Dill, her legal representatives, successors, and assigns for that certain property; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That all conditions necessary for issuance of a specific use permit have been met and a specific use permit to allow a beauty salon at 2225 Hazel Avenue, Beaumont, Jefferson County, Texas, is hereby granted to Alesha E. Dill, her legal representatives, successors and assigns for that certain tract described on Exhibit "A" attached hereto and made a part hereof for all purposes, subject to the above conditions. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Fuca; EXHIBIT "B" INTER - OFFICE MEMORANDUM CITY OF BEAUMONT, TEXAS DATE: March 26, 1992 TO: Memo to File 1185-P, 2225 Hazel FROM: Murray Duren, Senior Planner, Planning Division SUBJECT: Specific Use Permit, Beauty Shop, granted March 25, 1992, MINOR VARIATION REQUESTED. COMMENT Under Section 30-26 I. of the Code of Ordinance, the Planning Director may approve minor variations from the original permit which do not increase density, change traffic patterns, or result in any increase in external impact on adjacent properties or neighborhoods. The approved site plan (Ordinance No. 92-19) showed a 14 foot by 40 foot building, containing 560 square feet and lying 48 feet from the rear property line. The staff recommendation to the Planning Commission had been that the owner maintain at least a 40 foot rear yard setback. Mrs. Dill, the applicant, now requests that she be allowed to construct a building that will be 18 foot by 36 foot and contain 648 square feet. This is an increase of 88 square feet. The resulting rear yard will be 44 feet. She has submitted a revised site plan for the property, being Lot 4, Block 6, Averill Addition. I feel that this request meets the conditions stated above for a minor variation and that the revised site plan should be approved.
