ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 800 Schwarner (Garage) 3930 St. Helena (Rear) 800 Schwarner (Shed) 3675 Scranton 255 E. Threadneedle 3479 West 605 Nolan 1955 Tulane 605 Nolan (Shed) 1060 Trinidad 4540 Highland (Shed) 1080 Trinidad 2025 W. Highland 795 Pollard 3960 Usan 2341 Magnolia 3705 Usan 2575 7irou 3077 S. 5th 2575 7irou (Shed) 3940 Lydia 990 N. 7th 3295 Glenwood 2037 Laurel 950 Elm 2015 Liberty 5160 Wilshire 2035 Liberty 7960 Tolivar 2411 Pecos (Garage) 2225 Ives (Garage Apt) 2115 Rusk 3930 St. Helena each to be a public nuisance in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owners or owners of the following buildings either demolish or repair said structures within thirty (30) days of the effective date of this ordinance: 605 Nolan 3960 Usan 3705 Usan 3940 Lydia 2225 Ives (Garage Apt) 3930 St. Helena 1080 Trinidad If such action is not taken, request shall be made that the City Council authorize appropriate City officials to demolish and remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 800 Schwarner (Garage) 800 Schwarner (Shed) 255 E. Threadneedle 605 Nolan (Shed) 4540 Highland (Shed) 2025 W. Highland 3077 S. 5th 3295 Glenwood 950 Elm 5160 Wilshire 7960 Tolivar 3930 St. Helena (Rear) 3675 Scranton 3479 West 1955 Tulane 1060 Trinidad 795 Pollard 2341 Magnolia 2575 7irou 2575 7irou (Shed) 990 N. 7th 2037 Laurel 2015 Liberty 2035 Liberty 2411 Pecos (Garage) 2115 Rusk Section 4. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were theretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: 4750 Belmont 2480 Harriot 1325 Collis 3890 Hollywood (Comm) 1327 Collis 1405 Land 1715 Cottonwood 440 LaSalle 3920 Ethel (Shed) 2460 N. 9th 2060-62 Euclid 3152 Pine 3780 Fannett 3915 Scranton 894 Forrest 3915 Scranton (Rear) 1555 Forsythe (Shed) 1895 Washington 3345 Glenwood Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
