HomeMy WebLinkAboutORD 92-42 ORDINANCE NO. ��a ENTITLED AN ORDINANCE AMENDING CHAPTER 23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS RELATING TO THE REQUIREMENTS FOR HOUSE NUMBERING; AMENDING THE PENALTY RANGE FOR A VIOLATION; PROVIDING FOR SEVERABILITY;PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 23 of the Code of Ordinances of the City of Beaumont be, and the same is hereby amended to amend Section 23-2 and 23-3 to read as follows: Sec. 23-2. Building numbering - Prohibiting unmarked or incorrect number. It shall be unlawful for any person who owns a residence, business, house or other building in this city, or for any person who resides in a residence in this city, to fail to number such building with a plain and visible house number, or to fail to number such building correctly, so that the number of the same conforms to the plan adopted by the city. Proof of a culpable mental state, as defined in Chapter 6 of the Texas Penal Code, is not required to prove a violation of this section. Sec. 23-3. Violation; penalty. Every person who violates the provisions of Section 23-2 shall be guilty of a misdemeanor and shall be punished as provided in Section 1-8 of this Code, provided, however, that the court in its discretion may dismiss said violation if the defendant presents the court photographic or other compelling evidence that the building has subsequently been brought into compliance with Section 23-2. For each dismissal under this section, the court may assess a fee not to exceed ten dollars ($10.00). Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular person, or to a particular set of circumstances, should for any reason be held invalid, such invalidity shall not affect the remaining portions of this D-9�-y'z eS—S- 9a ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 3. That all ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4. That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
