ENTITLED AN ORDINANCE AMENDING
CHAPTER 20 OF THE CODE OF ORDINANCES
OF THE CITY OF BEAUMONT TO PROHIBIT
GLASS BEVERAGE CONTAINERS IN CITY
PARKS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL; AND PROVIDING
A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 20, Section 20-10 of the Code of Ordinance of the City of Beaumont be, and the
same is hereby amended to add a new subsection 20-10(i) to read as follows:
Section 20-10(i)
It shall be unlawful for any person to use or possess in any form, any glass beverage
container in any area situated within a City park as that term is defined in Section 20-1 hereof.
(1) The provisions of this section shall not apply where such glass container is used
or possessed inside or within any of the enclosed perimeters, structures, or
businesses within a park.
(2) It shall be unlawful for any business establishment or person situated within a
park other than a business establishment located in those areas described in
subsection "(1)" above to sell or offer for sale any beverage in a glass container
for on or off premises consumption use.
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason be
held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and
to such end the various portions and provisions of this ordinance are declared to be severable.
Section 3.
That all ordinances or parts of ordinances in conflict herewith are repealed to the extent
of the conflict only.
Section 4.
That any person who violates any provision of this ordinance shall, upon conviction, be
punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
