ENTITLED AN ORDINANCE AMENDING CHAPTER 10 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BY ESTABLISHING NEW REGULATIONS FOR THE ABOVE- GROUND STORAGE OF FLAMMABLE LIQUIDS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 10, Section 10-21, of the Code of Ordinances of the City of Beaumont be and the same is hereby repealed and a new Section 10-21 is hereby enacted to read as follows: "Section 10-21. Establishment of Regulations for the Storage of Explosive, Blasting Agents, Flammable Liquids in Outside Above-Ground Tanks, and Bulk Storage of Flammable and Combustible Liquids and Liquified Petroleum Gas. "(a) Storage of explosives and blasting agents and storage of flammable liquids in outside above-ground tanks of 10,000 gallons or less may be established within the zoning districts designated Heavy Industrial (H-I), Light Industrial (L-I), and Commercial-Manufacturing (C-M), as the same districts are defined in Chapter 30 of this Code of Ordinances and as found in the Zoning Map of the City of Beaumont. All such above-ground tanks and storage of explosives and blasting agents shall be permitted as required elsewhere in this code and shall be installed in complete compliance with all the requirements of the NFPA pamphlets, ANSI and API codes and any other applicable fire regulations which have been adopted by the City of Beaumont. Prior to filling such tanks or storing such explosives and blasting agents, the installation and site shall be approved in writing as complying with the above-referenced codes and regulations by the Fire Marshal of the City of Beaumont or his designee. "(b) The bulk storage of flammable and combustible liquids and liquified petroleum gas either in tanks larger than 10,000 gallons or as bulk storage in which the material is distributed either at wholesale or retail to customers may be established within the zoning districts designated Heavy Industrial (H-I) and Light Industrial (L-I) only after the issuance of a specific use permit as provided in the Zoning Ordinance of the City of Beaumont." Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 3. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 4. That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of the City of Beaumont, Texas.
