ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR CONSTRUCTION OF A 300 FOOT CELLULAR MOBILE PHONE COMMUNICATIONS TOWER AND UTILITY BUILDING IN AN AREA ZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING), PARTS OF TRACTS 48 AND 49, PLAT RS-5, D. EASLEY SURVEY, ABSTRACT NO. 20, LOCATED ON A 6.10 ACRE TRACT OF LAND, BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the Planning and Zoning Commission of the City of Beaumont considered the issuance of a specific use permit for construction of a 300 foot cellular mobile phone communications tower and utility building in an area zoned RS (Residential Single Family Dwelling), parts of tracts 48 and 49, Plat RS-5, Abstract No. 20, located in the 10,000 block of Black Lane on a 6.10 acre tract of land in the D. Easley Survey, Beaumont, Jefferson County, Texas, to GTE Mobilnet, their legal representatives, successors, and assigns for that certain property; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That all conditions necessary for issuance of a specific use permit have been met and a specific use permit to allow construction of a 300 foot cellular mobile phone communications tower in an area zoned RS (Residential Single Family Dwelling), parts of tracts 48 and 49, Plat RS-5, Abstract No. 20, located in the 10,000 block of Black Lane on a 6.10 acre tract of land in the D. Easley Survey, Beaumont, Jefferson County, Texas, to GTE Mobilnet, their legal representatives, successors and assigns for that certain tract described on Exhibit "A" attached hereto and made a part hereof for all purposes, subject to the above conditions. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended.
