HomeMy WebLinkAboutORD 91-55 ORDINANCE NO. -9Z-525— ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 3875 Bryan 894 Bonham 2116 Pope 1655 Brooklyn (Comm) 170 Manning 1665 Brooklyn (Shed) 3145 Taliaferro 1665 Brooklyn (Garage) 875 Pollard 1865 Brooklyn 2370 Linson 1010 Sherman 2470 Space (Garage Apt.) 4160 Brandon 1380-82 Grand (Garage Apt.) 685 Shell 1065 Bowie 685 Shell (Garage) 2526 Magnolia (Rear) 3480 Avenue B (Rear) 2310 Roman 4445 Flamingo 1475 Maple 2245 Lela 1709 McFaddin 3675 Usan 249-2nd (Rear) 2025 Southerland 2320 Liberty 2945 Sarah 330 Archie 2945 Glenwood 330 Archie (Rear) 3669 Westmoreland 850 Bonham 2155 Terrell 860-66 Bonham 1308 Victoria 870-76 Bonham 1360 Blanchette 880 Bonham 1210 Avenue G 890 Bonham 1210 Avenue G (Garage Apt.) 892 Bonham each to be a public nuisance in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Section 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owners or owners of the following buildings either demolish or repair said structures within thirty (30) days of the effective date of this ordinance: 2370 Linson 1065 Bowie 1709 McFaddin 2320 Liberty 685 Shell 1308 Victoria 1210 Avenue G 240 2nd (Rear) 2470 Space (Garage Apt.) 1360 Blanchette If such action is not taken, request shall be made that the City Council authorize appropriate City officials to demolish and remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 3875 Bryan 1210 Avenue G (Garage Apt.) 170 Manning 2116 Pope 875 Pollard 3145 Taliaferro 1380-82 Grand (Garage Apt.) 2310 Roman 2526 Magnolia (Rear) 330 Archie 1475 Maple 870-76 Bonham 850 Bonham 890 Bonham 330 Archie (Rear) 894 Bonham 860-66 Bonham 1665 Brooklyn (Shed) 880 Bonham 1865 Brooklyn 892 Bonham 4160 Brandon 1655 Brooklyn (Comm) 3480 Avenue B (Rear) 1665 Brooklyn (Garage) 2245 Lela 1010 Sherman 2025 Southerland 685 Shell (Garage) 2945 Glenwood 4445 Flamingo 2155 Terrell 3675 Usan 2945 Sarah 3669 Westmoreland Section 4. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were theretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: 440 Doucette 1128 Evalon 1810 Cottonwood 1138 Evalon 565 E. Gill 1148 Evalon 2560 Grove 1158 Evalon 8066 Mitchell 909 Franklin 5305 Phelps 1770 Gladys 3883 Fonville 1416 Gray 3145 Grand (Garage Apt.) 2133 Laurel Section 6. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 7. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
