ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 1535 Sabine Pass (Shed) 1535 Sabine Pass 1535 Sabine Pass (#9-4 Units) (#1-2 Units) 275 E. Simmons 1535 Sabine Pass (Garage) (#2-2 Units) 3350 Rivers Rd. 1535 Sabine Pass 3099 Washington (#3-4 Units) 2520 Sutherland 1535 Sabine Pass 781 Shell (#4-1 Unit) 781 Shell (Carport) 1535 Sabine Pass(#5-1 Unit) 3755 Preston 1535 Sabine Pass 1535 Sabine Pass (#6-6 Units) (#7-1 Unit) 1535 Sabine Pass (#8-1 Unit) each to be a public nuisance in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2 . In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103 .4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following buildings either repair or demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 3755 Preston If such action is not taken, request shall be made that the City Council authorize appropriate City officials to demolish and remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3 . The following structures are hereby ordered to be demolished and removed by the City of Beaumont on the account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were theretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: 1535 Sabine Pass 1535 Sabine Pass (Shed) (#1-2 Units) 1535 Sabine Pass 1535 Sabine Pass (#2-2 Units) (#3-4 Units) 1535 Sabine Pass 1535 Sabine Pass (#4-1 Unit) (#5-1 Unit) 1535 Sabine Pass 1535 Sabine Pass (#6-6 Units) (#7-1 Unit) 1535 Sabine Pass 1535 Sabine Pass (#8-1 Unit) (#9-4 Units) 275 E. Simmons 3350 Rivers (Garage) 3099 Washington 2520 Sutherland 781 Shell 781 Shell (Carport) Section 4. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on the account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were theretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: 1604 Avnue A 2401 Forrest 2520 Avenue A (Garage) 425 Frederick 1558 Avenue C 1256 Harriot 1558 Avenue C ( Rear) (Garage Apt. ) 1388 Johns 1805 Bolivar 2295 Leight 1910 Cleo 4022 Magnolia 2881 Concord (Comm) 4026 Magnolia 2883 Concord 2355 Pear 3025 Cordova 2411 Pecos (Garage) 3180 Cordova 1725 Pennsylvania 1455 Craig 887 Porter (Garage Apt. ) 1105 Elgie 2330 Potts Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
