ORDINANCE NO. ?0 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 3910 Congress 910 Congress (Garage) 1384 Grand 1012 Ave D 1407 M L King 310 E. Virginia 945 Fulton (Garage) 310 E. Virginia (Garage) 1540 Fulton 1760 W. Virginia 2110 Hemlock 3715 Preston 2695 Houston 2928 Goliad 2695 Houston (Rear) 2310 Harriot 1680 Turon 6695 Bigner 1670 Turon each to be a public nuisance in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2 . In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103 .4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following buildings either repair or demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 3910 Congress 3910 Congress (Garage) 1384 Grand 1012 Ave D 1407 M L King 310 E. Virginia 945 Fulton (Garage) 310 E. Virginia (Garage) 1540 Fulton 1760 W. Virginia 2110 Hemlock 3715 Preston 2695 Houston 2928 Goliad 2695 Houston (Rear) 2310 Harriot 1680 Turon 6695 Bigner 1670 Turon If such action is not taken, request shall be made that the City Council authorize appropriate City officials to demolish and remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3 . The following structures are hereby ordered to be demolished and removed by the City of Beaumont on the account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were theretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: 4090 Agnes 3910 Johnstown 2855 Amarillo 2133 Laurel (Rear) 1162 Ashley (Rear) 2070 Linson 645 Blanchette 1215 E. Lucas 1399 Cable 7925 Mitchell 3490 Cleveland (Comm) 7925 Mitchell (Shed) 2305 Fillmore 140 Pollard 4445 Flamingo (Carport) 3975 St. Helena 1139 Forrest 3445 St. James 1580 Fulton 3455 St. James 891 Gladys 3463 St. James 530 Hill 1406 W. Virginia Section 4. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 5. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. ?
