HomeMy WebLinkAboutORD 90-67 ORDINANCE NO. 9 -6 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 775 Avenue A 185 Fletcher 1771 Herring Alley 1875 Forsythe 992 M L King N 972 M L King N each to be a public nuisance in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2 . In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103 .4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following buildings either repair or demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 775 Avenue A 1875 Forsythe If such action is not taken, request shall be made that the City Council authorize appropriate City officials to demolish and remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3 . In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103 .4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 1771 Herring Alley 992 M L King N 972 M L King N 185 Fletcher Section 4. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on the account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were theretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: 1975 Ashley 3955 Inez 745 Avenue D 890 Jackson 745 Avenue D (Garage Apt. ) 235 Manning 2289 Broadway 1386 Orange 1748 Delaware 2805 Orange 4190 Harding 1990 Orange 2307 Pope 4155 Pradice 2125 Hebert 3755 Preston 2405 Hegele 5375 Sunset (Garage) 2695 Houston 1513 Victoria 2695 Houston (Rear) Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
