ENTITLED AN ORDINANCE AMENDING CHAPTER 28 OF
THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT
ADOPTING WATER AND SEWER RATE SCHEDULES;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL; PROVIDING FOR AN EFFECTIVE DATE;
AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 28, Section 28-50 (a) , (b) and (c) of the
Code of Ordinances of the City of Beaumont be, and they are hereby,
amended to read as follows:
Section 28-50 (a) :
The following rates per month shall be the rates charged
for water service furnished to customers within and
outside the corporate limits of the City, except as
provided in paragraph (b) of this section.

Section 28-50 (b) :
The minimum monthly bill for eligible senior citizens who
comply with 28-50 (c) and yard meters will be reduced by $1.44 and
they will pay the volume charge for all metered usage.
Section 28-50 (c) :
Eligible senior citizens shall mean customers residing in
a single-family residence inside the City who are over the age of
sixty-five (65) years. To obtain the monthly minimum charge
deduction, persons eligible must file a sworn application, on a
form provided therefor, with the Water Utilities Department. Upon
approval of the application the senior citizen's monthly minimum
charge shall be applicable for the life of the applicant.
Section 2 .
That Chapter 28, Section 28-51(a) of the Code of Ordinances
of the City of Beaumont be, and it is hereby, amended to read as
follows:
Section 28-51(a) •
(a) The following rates per month shall be the rates
charged for sanitary sewer service furnished to customers
within and outside the corporate limits of the City where
the sewage produced by such customers is a normal strength
wastewater (150 mg/1BOD, 550 COD and 200 mg/1 Total
Suspended Solids) as provided in Sec. 28-100 Paragraph J and
Sec. 28-104 Paragraph C.

Section 28-51(b) :
The minimum monthly bill for eligible senior citizens who
comply with 28-50 (c) will be reduced by $1. 38 and they will pay the
volume charge for all metered usage.
Section 28-51(c) :
Residential inside city sewer charges for the months of
November, December, January, and February will be based on actual
metered water usage. Sewer charges for the months of March through
October will be based on the average of the monthly water usage of
the preceding months of November through February, or the actual
usage for the months of March through October, whichever is less.
Where no preceding November through February monthly average volume
is available from records, the director of water utilities shall
establish an average monthly volume based on the average monthly
water usage of all residential water users in each particular cycle
route for the winter months set out above.
Section 28-51(d) •
Commercial and industrial sewer usage charges shall be based
on one hundred (100) per cent of the metered water usage. In
circumstances where a commercial or industrial customer desires a
credit for metered water being consumed but not being returned to
the sanitary sewer, it shall be the responsibility of the user to
furnish to the director of water utilities an engineering report,
certified by a professional engineer, that justifies and supports
the discharge reduction as being a continuous normal part of the
process. Based on the data provided the director of water
utilities may estimate said return or require submetering of the
process water. Meter used for submetering shall be furnished at
the customer's expense and shall be approved by the director of
water utilities.
Section 3 .
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set
of persons or circumstances, should for any reason be held to be
invalid, such invalidity shall not affect the remaining portions
of this ordinance, and to such end the various portions and
provisions of this ordinance are declared to be severable.
Section 4 .
All ordinances or parts of ordinances in conflict herewith
are repealed to the extent of the conflict only.
Section 5.
This ordinance will be and become effective from and after
January 1, 1991.
Section 6.
Any person who violates any provision of this ordinance
shall, upon conviction, be punished as provided in Section 1-8 of
the Code of Ordinances of Beaumont, Texas.
