HomeMy WebLinkAboutORD 03-079 ORDINANCE NO. 03-079 ENTITLED AN ORDINANCE AUTHORIZING COLLECTION FEES ON CERTAIN UNPAID FEES, FINES, COURT COSTS, FORFEITED BONDS AND RESTITUTION ORDERS IN MUNICIPAL COURT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That there is hereby authorized a collection fee in the amount of thirty percent(30%) of debts and accounts receivable, such as unpaid fines, fees, court costs, forfeited bonds and restitutions, ordered paid by a municipal court serving the City of Beaumont and on amounts in cases in which the accused has failed to appear: (1) as promised under subchapter A, Chapter 543, Transportation Code, or other law; (2) in compliance with a lawful written notice to appear issued under Article 14.06b, Texas Code of Criminal Procedure or other law; (3) in compliance with a lawful summons issued under Article 15.03b,Texas Code of Criminal Procedure;or(4)in compliance with a lawful order of court serving the City when such debts, accounts receivable and amounts are more than sixty (60) days past due and have been referred to an attorney or other vendor for collection. Section 2. That if any section, subsection, sentence, clause of phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end, the various portions and provisions of this ordinance are declared to be severable. Section 3 That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 4 That any person who violates any provision of this ordinance shall, upon conviction, be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
