HomeMy WebLinkAboutORD 89-83 ORDINANCE NO. - ,3 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING FROM R-3, (MODIFIED TWO-FAMILY AND MULTIPLE DWELLING) , RS (RESIDENTIAL SINGLE FAMILY DWELLING) , RM- H (RESIDENTIAL MULTIPLE-FAMILY DWELLING - HIGHEST DENSITY) TO RCR (RESIDENTIAL CONSERVATION AND REVITALIZATION DISTRICT) , GC-MD (GENERAL COMMERCIAL MULTIPLE-FAMILY DWELLING) , RCR (RESIDENTIAL CONSERVATION AND REVITALIZATION DISTRICT) , RS (RESIDENTIAL SINGLE FAMILY DWELLING) ON PROPERTY LYING 150 FEET EAST OF ELEVENTH STREET AND EXTENDING EASTWARD TO THIRD STREET, SAID LAND BEING SITUATED NORTH OF LAUREL AVENUE AND SOUTH OF LOTS FRONTING ALONG NORTH, HAZEL AND HARRISON STREETS, BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-5B thereof, is hereby amended by changing the zoning classification as follows: 1 . Property recommended to be rezoned from R-3 to GC-MD includes all of the lots and parcels of land lying west of Tenth Street, being the R-3 lots in the south half of Block 50 and all of the R-3 lots in Blocks 48 and 49 , Averill Addition and including Lots 3, 4, 5 and 6, Block 1 , Palm Place Addition. 2. Property recommended to be rezoned from RS to RCR is the north one-half of the site of the former Averill Elementary School now the B.I.S.D. Vocational Training Center on Seventh Street, being Lots 1 -7 , Block 19, Averill Addition. 3. Property recommended to be rezoned from R-3 to RS includes Lots 1 -12, Block 32 and Lots 1 and 2 , Block 33, McFaddin Second Addition. 4. Property recommended to be rezoned from RM-H to RS is Tract 2, Block 1 , Oaks Addition, said tract lying on l� - � %- 1/.2 z.5= C9 the west side of Seventh Street between Laurel Avenue and South Street. 5. Property recommended to be rezoned from R-3 to RCR includes the property as shown on Exhibit "A" attached hereto and made a part hereof for all purposes. The official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1 -8 of the Code of Ordinances of Beaumont, Texas. Tract Two Beginning at a point in the center of the 60 ' wide Third Street right-of-way, said point being located 185 ' south of the intersection of the 70 ' wide Calder Avenue Street right- of-way with the centerline of said Third Street; Thence west along rear lot lines and across several streets to a point for corner in the centerline of the 60 ' wide Tenth Street right-of-way; Thence south to a point in the centerline of Laurel Avenue; Thence east along the centerline of Laurel Avenue a distance of approximately 20 ' to a point for corner; Thence south to a point in the north line of Block 1 , Palm Place Addition, same being located at the northwest corner of Lot 2, Block 1 , Palm Place Addition and same being the northeast corner of Lot 3, said block and addition; Thence continuing south a distance of 150 ' to a point for corner in the southwest corner of Lot 2 and the southeast corner of Lot 3, said block and addition; Thence east across rear lot lines and several streets to a point for corner in the centerline of the 20 ' wide alley right-of-way in Block 3, Parkdale Addition; Exhibit "A" Thence north a distance of 10 ' to a point and continuing north along the common side lot lines of Lots 3 and 4, said block and addition to a point in the south line of Laurel Avenue, and continuing north across Laurel to a point for corner in the centerline of the 20 ' wide alley right-of-way in Block 4 , McFaddin 2nd Addition to a point for corner; Thence east to a point for corner in the centerline of Third Street; Thence north to the place of beginning of the above- described tract No. 2. .
