HomeMy WebLinkAboutORD 90-2 ORDINANCE NO. 9® - a ENTITLED AN ORDINANCE AMENDING CHAPTER 23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO AMEND SECTIONS 23-83 AND 23-84 TO PROVIDE AN EXEMPTION FOR DISABLED PERSONS, PROVIDE ADDITIONAL TIME TO PAY, REDUCE THE COLLECTION CHARGE AND REMOVE THE INTEREST CHARGE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 23, Sections 23-83 and 23-84, of the Code of Ordinances are hereby amended to read as follows: Section 23-83: There is hereby established a perpetual street maintenance and construction fund to be used for the maintenance and necessary reconstruction of the street system of the City. The following monthly service fees for such fund are hereby established for each residential unit and commercial establishment with in the City: Residential Unit.......................................................................$3.00/month Senior Citizens Rate...............................................................$1.00/month A senior citizen's rate of One Dollar ($1.00) per month shall apply to customers residing in single-family residences who are sixty-five (65) years of age or older. To obtain the senior citizen's rate, eligible persons must file a sworn application on a form provided therefor with the Central Collections Division. The rate shall remain in effect so long as the customer residing in the single-family residence or subsidized residential unit remains qualified, as set out herein. For purposes of this ordinance, a residential unit occupied by a disabled person shall qualify for an exemption from the fee. A disabled person is a person who, by reason of illness, injury, age - 1 > congenital malfunction or other permanent incapacity or disability, is unable, without special planning, design or facilities, to use mass transit services. To obtain the disabled person's exemption a person must file a sworn application on a form provided by the Central Collections Division. Occupants of public housing or federally subsidized low income rental housing shall be exempt from the fee. Section 23-84. Street maintenance fees will be payable within sixty (60) days of the date of billing by the City. Failure to pay such street maintenance fee within said sixty (60) days after the billing date will result in the addition of an administration collection charge of three Dollars ($3.00). Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 3. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 4. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. - 2 - PASSED BY THE CITY COUNCIL of the City of Beaumont this the 9W day of , 1990. - Mayor - - 3 -
