ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 887 Porter (Garage Apt. ) 2412 Park 605 Van Buren (Garage) 2805 Orange 605 Van Buren (Shed) 2411 Pecos (Garage) 1270 Harriot 5281 Roberts 2199 Victoria 3150 Waverly 1256 Harriot 425 Jackson 1256 Harriot (Garage Apt. ) 1397 Liberty 3975 Octavia 3915 Scranton 3975 Octavia (Garage) 3915 Scranton (Garage) 5375 Sunset 5270 Wilshire 5375 Sunset (Garage) each to be a public nuisance in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following buildings either repair or demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 1270 Harriot 2199 Victoria 1256 Harriot 3975 Octavia 3975 Octavia 5375 Sunset (Garage) 5375 Sunset 2805 Orange (Garage) 5281 Roberts 2411 Pecos 3150 Waverly (Garage) 5270 Wilshire 1397 Liberty 3915 Scranton 3915 Scranton (Rear) 3402 Texas (Rear) If such action is not taken, request shall be made that the City Council authorize appropriate City officials to demolish and remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103 .4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within thirty (30) days of the effective date of this ordinance: 887 Porter 605 Van Buren (Garage Apt. ) (Garage) 605 Van Buren 1256 Harriot (Shed) (Garage Apt. ) 2412 Park 425 Jackson Section 4. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on the account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were theretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: 552 Alma (Rear) 2805 Orange (Garage) 605 Blanchette 2032 Pennsylvania 1805 Bolivar (Rear) 2018 Primrose 4068 Brandon 2555 Primrose (Rear) 510 Cotton Courts 701 Prince 440 Flowers 3632 St. James 2385 Forrest 2398 Goliad (Garage 3990 Goliad Apt. ) 1072 Grand 765 Trinity 1065 Grant 2024 Tulane (Rear) 1345 Grant 2065 Tulane 1120 Vermont 760 Van Buren 3690 Waco 2236 Washington 1355 Maple 4353 Ogden 3344 West 3344 West (Garage) 4357 Ogden 3555 St. James Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
