HomeMy WebLinkAboutORD 88-94 A T+a® ORDINANCE NO. 9 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 1157 North 1550 Tagore 1141 north 460 Threadneedle 1264 Center 460 Threadneedle (rear) 1428 Oakland 625 Anchor 1899 Harrison 673 Anchor 2289 Broadway 677 Anchor 1037 Gladys 1399 Cable 1076 Gladys 1542 Cable 1078 Gladys 1950 Cable 1557 Gladys 2462 Pine 1750 Gladys 3040 Pine 1760 Gladys (Rear) 430 Fletcher (Rear) 1310 Louisiana 3060 Case 1310 Louisiana (Rear) 3225 Grand 1350 Louisiana 3540 West 1365 Louisiana 3540 West (Garage Apt. ) 1475-77 Louisiana 3605 Johnstown 1481 Louisiana 3650 St. Helena 2935 Astor 2250 Toledo 2945 Astor 2250 Toledo (Garage) 2965 Astor 2110 Hayes Lane 2985 Astor 2385 Monroe 2995 Astor 740 Jackson. 1835 Rivercrest (Garage) 4196 Kenneth 747 Stanton 4245 Congress 757 Stanton 4210 Bob 805 Stanton 3603 Waverly 2375 Marrison each to be a public nuisance in that said buildings violate Chapter 14, Section 14-50 of the CoCe of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2 . In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103. 4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following buildings either repair or demolish and remove said structures within thirty (30 ) days of the effective date of this ordinance: 1264 Center 1899 Harrison 2289 Broadway 1037 Gladys 1557 Gladys 1750 Gladys 1350 Louisiana 1365 Louisiana 1475-77 Louisiana 1481 Louisiana 805 Stanton 460 Threadneedle 673 Anchor 3060 Case 3540 West 2250 Toledo 1835 Rivercrest (Garage) 4196 Kenneth If such action is not taken, request shall be ziiade that the City Council authorize appropriate City officials to demolish and remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103. 4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described building demolish and remove said structure within thirty ( 30 ) days of the effective date of this ordinance: 2 1157 North 1141 North 1428 Oakland 1076 Gladys 1073 Gladys 1760 Gladys (Rear) 1310 Louisiana 1310 Louisiana (Rear) 2935 Astor 2945 Astor 2965 Astor 2985 Astor 2995 Astor 740 Jackson 747 Stanton 757 Stanton 2375 Morrison 1550 Tagore 460 Threadneedle (Rear) 625 Anchor 677 Anchor 1399 Cable 1542 Cable 1950 Cable 2462 Pine 3040 Pine 430 Fletcher (Rear) 3225 Grand 3540 West (Garage Apt. ) 3605 Johnstown 3650 St. Helena 2250 Toledo (Garage) 2110 Hayes Lane 2385 Monroe 4245 Congress 4210 Bob 3603 Waverly If such action is not taken, the owners of said buildings shall be deemed guilty of a misdemeanor and said buildings shall be demolished and removed at the expense of the City of Beaumont on the account of the owner thereof and such expense shall be assessed as a special tax against the property upon which said buildings are situated and a lien shall exist for such special tax, which lien shall be foreclosed and said expense be recovered by the City of Beaumont as in the case of any other debt and lien in favor of the City of Beaumont. Section 4. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on the account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were theretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City: - 3 - 2417-19 Broadway 795 Elgie 2378 Goliad 2912 Magnolia 2530 Burgundy 3590 Johnstown 5250 Sunset Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1 -8 of the Code of Ordinances of Beaumont, Texas.
