HomeMy WebLinkAboutORD 89-13 ORDINANCE NO. _8 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 2226 Magnolia 2385 Forrest 2228 Magnolia 2213 Forrest 2340-50 Magnolia (Rear) 2213 Forrest (Rear) 2385 Magnolia 658 Emmett 2385 Magnolia (Rear) 696 Emmett 3403-05 Magnolia 1477 Land 3405 Magnolia (Commercial) 2625 Denver 3405 Magnolia (Garage) 1475 Beech 2595 Texas 1825 Cottonwood 1867 Texas 2455 Jirou 1857 Texas 2455 Jirou (Rear) 1530 Texas 1450 Concord 1580 Linson 1448 Concord 2306 Linson (Rear) 1430 Concord 950 Spruce 2710 Cox 950 Spruce (Rear) 395 Jeanette (Rear) 2655 Santa Fe (Garage) 395 Jeanette 2655 Santa Fe 3645 West 2655 Santa Fe (Rear) 1366-72 Neches 1935 May 3029 Hollywood 2345 Grand 5475 Seale Rd. 2333 Grand 902 Goliad 2401 Forrest 405 San Jacinto each to be a public nuisance in that said buildings violate Chapter 14 , Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following buildings either repair or demolish and remove said structures within thirty (30 ) days of the effective date of this ordinance: 2340-50 Magnolia 2385 Magnolia 1867 Texas 950 Spruce 2655 Santa Fe 1935 May 2345 Grand 2333 Grand 2401 Forrest 2385 Forrest 2455 Jirou 395 Jeanette 3645 West 950 Spruce (Rear) If such action is not taken, request shall be made that the City Council authorize appropriate City officials to demolish and remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas and Section 103. 4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following described buildings demolish and remove said structures within thirty (30 ) days of the effective date of this ordinance: 2226 Magnolia 2228 Magnolia 2385 Magnolia (Rear) 3403-05 Magnolia 2 3405 Magnolia (Commercial) 3405 Magnolia (Garage) 2595 Texas 1857 Texas 1530 Texas 1580 Linson 2306 Linson (Rear) 405 San Jacinto 2655 Santa Fe (Garage) 2655 Santa Fe (Rear) 2213 Forrest 2213 Forrest (Rear) 658 Emmett 696 Emmett 1477 Land 2625 Denver 1475 Beech 1825 Cottonwood 2455 Jirou (Rear) 1450 Concord 1448 Concord 1430 Concord 2710 Cox 395 Jeanette (Rear) 1366-72 Neches 3029 Hollywood 5475 Seale Rd. 902 Goliad If such action is not taken, the owners of said buildings shall be deemed guilty of a misdemeanor and said buildings shall be demolished and removed at the expense of the City of Beaumont on the account of the owner thereof and such expense shall be assessed as a special tax against the property upon which said buildings are situated and a lien shall exist for such special tax, which lien shall be foreclosed and said expense be recovered by the City of Beaumont as in the case of any other debt and lien in favor of the City of Beaumont. Section 4. The following structures are hereby ordered to be demolished and removed by the City of Beaumont on the account of the owners thereof and such expense of demolition and removal shall be assessed as a special tax against the properties upon which the buildings are situated. The following structures were theretofore declared to be public nuisances in violation of Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont: 2443 Cable 1109 North 663 Elm 795 Elgie (Rear) 1405 Center 2812 Park 3 1425 Center 4420-30 Pershing 1412 Center 1037 Gladys Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 6 . That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1 -8 of the Code of Ordinances of Beaumont, Texas.
