Home My WebLink AboutORD 89-26 ORDINANCE NO. 26 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR REPAIR OR DEMOLITION; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That the City Council of the City of Beaumont hereby finds and declares the buildings located at: 650 Jackson 1910 Cleo 1876 Pennsylvania (Rear) 1387 Schwarner 1876 Pennsylvania 2185 Hemlock 1871 Pennsylvania (Rear) 1440 Sherman 1840 Pennsylvania 1707 Pennsylvania 1350-52 Bradley Alley 1675-77 Pennsylvania 1354-56 Bradley Alley 1665-67 Pennsylvania 1362-64 Bradley Alley 505 McGovern 448 Irma 525 McGovern 1840 St. Anthony 376 Fredrick 670 Sherman 430 Langham 1150 Powell 1474 Ave D 1345 Grant 1072 Grand 1081 Grant 1135 Grand 1065 Grant 1135 Grand (Storage) 855 Madison 883 Gladys 1120 Vermont 856 Miller 2960 Cartwright 1093 Willow 1965-75 Sabine Pass 828 Long 1965-75 Sabine Pass (Rear) 848 Long 1985-95 Sabine Pass 850 Long 440 Flowers 1025 Willow 440 Flowers (Rear) 1027-29 Willow 1270 Harriot 1031 -33 Willow 1270 Harriot (Garage) 1370 Forrest 1406 W. Virginia 1012 Evalon 2721 Forrest 1105 Evalon 1826 Sabine Pass 1238 Evalon 710 Pine 1320 Evalon 2032 Pennsylvania 1330 Evalon each to be a public nuisance in that said buildings violate Chapter 14, Section 14-50 of the Code of Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or G // I dilapidated condition, likely to cause or promote fires that would endanger persons or property. Section 2. In accordance with Article XVII, Section 2 of the Charter of the City of Beaumont, Sections 10-2 and 14-52 of the Code of Ordinances of Beaumont, Texas, and Section 103.4 of the Standard Building Code, it is hereby ordered that the owner or owners of the following buildings either repair or demolish and remove said structures within thirty (30 ) days of the effective date of this ordinance: 1910 Cleo 1440 Sherman 1065 Grant 1270 Harriot 2721 Forrest 2032 Pennsylvania 1871 Pennsylvania (Rear) 1840 Pennsylvania 1474 Ave D 1072 Grand 848 Long 850 Long 1238 Evalon 1330 Evalon 1406 W. Virginia If such action is not taken, request shall be made that the City Council authorize appropriate City officials to demolish and remove said structures at the expense of the City of Beaumont on account of the owner thereof and such expense shall be assessed as a special tax against the property upon which the buildings are situated. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 5. That any person who violated any provision of this ordinance shall, upon conviction, be punished as provided in Section 1 -8 of the Code of Ordinances of Beaumont, Texas. - 3 - PASSED BY THE CITY COUNCIL of the City of Beaumont this the 25th day of April , 1989. f, Mayor - 4
