ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO ALLOW A HELIPORT AT THE NORTHEAST CORNER OF LIBERTY AVENUE AND 15TH STREET ON LOTS 11 -15, BLOCK 29, JARRETTE ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, the Planning and Zoning Commission of the City of Beaumont considered the issuance of a specific use permit to allow a heliport at the northeast corner of Liberty Avenue and 15th Street on Lots 11 -15 , Block 29, Jarrette Addition, Beaumont, Jefferson County, Texas, to Sisters of Charity of the Incarnate Word, property owners, their legal representatives, successors, and assigns for that certain property hereinafter described, conditional upon the following; 1 ) the specific use permit is issued on a temporary basis (18 months maximum) ; 2) the applicant follow and adhere to guidelines of the Helicopter Association International regarding the control of noise, dust and vibration; 3) FAA approval in the form of a "Letter of No Objection", as defined in Chapter 2-1 /4 of the City Code, be received by the applicant; and 4) unless prevented by prevailing winds, flight patterns are not to include routes over highly populated areas; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That all conditions necessary for issuance of a specific use permit have been met and a specific use permit to allow a heliport at the northeast corner of Liberty Avenue and 15th Street on Lots 11 -15, Block 29, Jarrette Addition, Beaumont, Jefferson County, Texas, is hereby granted to the Sisters of Charity of the Incarnate Word, property owners, their legal representatives, successors and assigns for that certain tract described on Exhibit "A" attached hereto and made a part hereof for all purposes, conditional upon the above stipulations. Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. McGowan Associate Architectural Consultants, Inc. 4131 Spicewood Springs Road Suite E-1 Austin, TX 78759 Dear Mr. McGowan: The Federal Aviation Administration (FAA) has completed its airspace utilization study (Study No. 89-ASW-0090-NRA) of the St. Elizabeth Hospital Heliport No. 3 near Beaumont, Texas. There is no objection to the proposal from an airspace"utilization standpoint provided: a. Ingress/egress routes are established so as to avoid the housing areas located to the northwest and southwest. b. The sponsor establishes a means of control to avoid conflict of aircraft using the three different helipads at this hospital. The three helipads at this hospital are on the parking garage (89-ASW-0088-NRA), on the hospital roof (89-ASW-0089-NRA), and in the parking lot (89 ASW-0090-NRA). This helipad is located in the parking lot of the hospital and has been in existence for some time. After the new helipad on top of the of the hospital building is completed, this helipad will be either abandoned or used only in the case of disasters and for parking. It is currently being used primarily to Park helicopters. This determination should not be construed to mean FAA approval of the physical development involved in the proposal nor as approval of its effect on the environment. It is only a determination with respect to the safe and efficient use of airspace by aircraft. In making this determination, the FAA has considered matters such as the effect the proposal would have on existing or contemplated traffic patterns of neighboring airports, the effects it would have on the existing airspace structure and projected programs of the FAA, and the effects that existing or proposed manmade objects (on file with the FAA) and known natural obiects within the affected area would have on the airport proposal. fiUs determination in no way preempts or waives any ordinances, laws, or regulations of any otter governmental body or agency. Additionally, we wish to advise that the FAA cannot prevent the construc- tion of any structure near an airport or heliport. Protection of the airport environs can be accomplished only through such means as local airport zoning ordinances and acquisition of property rights. In order to avoid placing any unfair restrictions on users of the navigable airspace, this determination is valid until August 1, 1990. Should the construction not be accomplished by this date, an extension of our determination may be requested. Please conplete the enclosed FAA Form 5010-5 (yellow card) and return it when the facility is operational. If we have not received this form by the above date, we will assume that the plans to establish the facility have been abandoned and will remove it from our active files.
