HomeMy WebLinkAboutORD 89-58 ORDINANCE NO. -57 ENTITLED AN ORDINANCE AMENDING CHAPTER 23, OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ADD A NEW ARTICLE IV ESTABLISHING A FUND AND A SERVICE FEE FOR STREET MAINTENANCE AND CONSTRUCTION; PROVIDING FOR COLLECTION CHARGES; PROVIDING AN EFFECTIVE DATE, PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. WHEREAS, the City of Beaumont desires to establish a perpetual fund to be used solely for reconstruction and maintenance of City streets; and, WHEREAS, the City streets are used by all residences and commercial establishments within the City and are available for such use at all times; and, WHEREAS, streets, their reconstruction and maintenance should be supported by a service fee which recognizes that commercial establishments generate more traffic than residential units; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 23 of the Code of Ordinances is hereby amended to add a new Article IV to read as follows: ARTICLE IV Street Use Service Fee Section 23-83 • There is hereby established a perpetual street maintenance and construction fund to be used for the maintenance and necessary reconstruction of the street system of the City. A service fee of $3 (three dollars) per month is hereby established for each residential unit and commercial establishment within the city. ?--,/ 6 - P9 A Senior Citizens Rate of $1 a month shall apply to customers residing in single-family residences who are sixty-five (65) years of age or older. To obtain the senior citizens rate, eligible persons must file a sworn application on a form provided therefore with the Central Collections Division. The rate shall remain in effect so long as the customer residing in the single-family residence or subsidized residential unit remains qualified, as set out herein. Occupants of public housing or federally subsidized low income rental housing shall be exempt from the fee. Section 23-84• Street Use service fees will be payable within thirty (30) days of the date of billing by the City. Failure to pay such Street Maintenance Fee within said thirty (30) days after the billing date will result in the addition of an administration collection charge of Fifteen Dollars ($15. 00) . In addition, all unpaid Street Use Service Fees will bear interest at the rate of ten percent (10%) per annum. Section 2 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 3 . All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only Section 4. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. Section 5.
