HomeMy WebLinkAboutORD 88-75 A II IM N ORDINANCE NO. gP• '7,5-_ ENTITLED AN ORDINANCE AMENDING CHAPTER 06 , ARTICLE IV, OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT CONCERNING THE ELECTRICAL CODE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Chapter 6, Section 6-51 of the Code of Ordinances of the City of Beaumont be amended as follows and -those definitions not amended herein shall remain the same: Section 6-51 : Definitions Electrical Contractor: Any person or firm engaged in the business of providing and selling electrical services. He shall have a permanently established place of business with a published telephone number. He shall hold a "master electrician' s" certificate or shall employ an individual who does and carry him on his active payroll. A master electrician may not qualify more than one ( 1 ) contractor. He shall be available to the inspection authority to answer any questions relating to electrical work coming under the Jurisdiction of this electrical inspection authority. Master Electrician: Any person who is, by training, experience, and education, competent to 'Lay out, design, and install a system of wiring for light, heat, or power. Limited Master Electrician: Any person who is, by training, experience, and education, competent to lay out, design, and install a system, of wiring for light, heat, or power. He shall be limited to performing electrical work on the property of a firm, co-partnership, or corporation on whose active payroll he is carried. Plant Electrician: Any person holu"_Lng a master or limited master electrician' s certificate who is carried on the active payroll of a firm, co-partnership, or corporation for the purpose of performing or supervising the performance of electrical work, on the property of his employer. He shall be available to the inspection authority to answer any questions relating to electrical work coliting under the jurisdiction of this electrical authority. Section 2. That Chapter 6, Section 6-81 of the Code of Ordinances of the City of Beaumont be amended to read as follows: Section 6-81 : Registration Classification There shall be six (6 ) classes of electrical registration which shall be known as follows: 1 ) Master electrician; 2 ) Limited master electrician; 3 ) Limited electrician ( sign) ; 4 ) Maintenance electrician; 5 ) Journeyman electrician; 6 ) Sign erector. Section 3. That Chapter 06 , Section 6-82 of the Code of Ordinances of the City of Beaumont be amended to read as follows: Sect-ion 6-82 : Application for Examinations; Fees; Issuance (a) All applicants for examination for masters, limited masters, journeymen, maintenance and lii-Liited electrician ( sign) shall be referred to the South East Texas Regional Electrical Examination Board. (b) All applicants for the limited master electrician certificate must meet one ( 1 ) of the following criteria: 1 ) Four ( 4) years experience in electrical work at a journeyman' s level; 2 ) Possession of a degree in electrical engineering and two (2 ) years ' experience in electrical work at a journey-man' s level; 3 ) Possession of a degree in electrical engineering and registration as an electrical engineer in the State of Texas. All applicants for the limited -masters certificate shall submit to the board a resume describing his history of electrical work and listing references who may be contacted for verification. if the applicant meets one of the specified criteria, the board will request, in writing, to the South East Texas Regional Electrical Examining Board, that the applicant be given the examination for master electrician. - 2 - (c) The following fees and bonds shall be applicable in this Code: Annual Surety Classification Registration Renewal Bond (1 ) Master Electrician $50. 00 $25.00 $1 ,000 . 00 (2 ) Limited Master 50 .00 25. 00 1 ,000 .00 Electrician (3 ) Limited Electrician 25 .00 25.00 1 ,000 .00 (Sign) ( 4) Journeyman Electrician 5.00 5.00 None (5 ) Maintenance Electrician 5. 00 5.00 None (6 ) Sign Erector 5.00 5.00 None Section 4. That Chapter 6, Section 6-100 of the Code of Ordinances of the City of Beaumont be amended to read as follows: Section 6-100 : Required; to Whom Issued; Exemption (a) Permits shall be issued to master or limited master electricians qualified to secure permits, as set forth in this code, or to their duly authorized agent. Qualified master or limited master electricians shall certify their duly authorized agent to the chief electrical inspector in the form of an affidavit stating that such master or limited master electrician assumes all and full responsibility for any permit taken out or applied for by such agent. This certification shall be kept in the chief electrical inspector' s file after it has been approved by the City Attorney. (b) When one (1 ) master or limited master electrician completes the rough work, in whole or in part, done any electrical wiring or installation of fixtures or equipment and a second master or limited master is called upon to complete the work, in whole or in pert, then a separate permit is required for which regular fees shall be paid for the work to be done. Each master or limited master electrician shall be held responsible only for the work installed by hM Before the second master or limited master electrician is issued a permit for the completion of an electrical wiring or installation of fixtures or equipment job, the chief electrical inspector shall first notify the master or limited master electrician holding the original or first permit, if he can be found, that the second permit is to be issued. The issuance of the second permit shall cancel the first permit and no refund of fees shall be made. - 3 (c) Master or limited master electricians acting in the capacity of plant electricians shall be issued permits for work to be performed on the property of their employer. Such master or limited master electrician shall be registered with the electrical inspection authority as the plant electrician for his employer who shall be named in the registration. (d) Nothing in this code shall be construed to prevent a person from doing electrical work himself on his own residence which is owned and occupied by him as such, so long as he complies with all of the other provisions of this code. This exception shall be construed to mean an individual owner (not firm, co-partnership, or corporation who actually does the labor himself) . This individual owner shall be present at the time of any electrical inspection. Section 5. That Chapter 6, Section 6-101 of the Code of Ordinances of the City of Beaumont be amended to add subsection (e) to read as follows: Section 6-101 (e) : Application; Scope of Permit Requirements Plans for buildings of more than five thousand ( 05 , 000 ) square feet, based on exterior dimensions or more than two (2 ) stories in height, shall bear the seal and signature of a professional electrical engineer licensed in the State of Texas. Section 6 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. 4 Section 5. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only . Section 5. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1 -8 of the Code of Ordinances of Beaumont, Texas.
