ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ESTABLISH THE REQUIREMENT OF A SPECIFIC USE PERMIT FOR CERTAIN LIGHT INDUSTRIAL LAND USES; PROVIDING CONDITIONS FOR SUCH SPECIAL USE PERMITS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Chapter 30, Section 30-24(b) , the same being the "Permitted Use Table" of the city' s zoning ordinance, be, and the same is hereby, amended to place a "18" in the Special Conditions column on such Permitted Use Table under SIC Group Nos. 202, 203, 2045, 205, 21 , 22, 23, 243, 244, 2499, 25, 264, 265, 31 , 324, 327 , 354, 355, 357, 358, 359. Section 2. That Chapter 30, Section 30-33(b) be, and the same is hereby, amended by adding a new special condition "18" to read as follows: Section 30-33(b) : 18. The land uses listed under SIC Group number 20 through 26, 30 through 32, 34, 35, 37 and 44 shall be permitted within the GC-MD, CDB and C-M zoning districts if, (1 ) granted a specific use permit and, (2 ) comply with the following conditions: a) All business-related activities, including storage of materials and equipment, shall be conducted within a completely enclosed structure. b) All lighting shall be situated so as not to cast or reflect light on any residential property. - -CPO �- �� c) A Traffic Circulation Plan showing all parking, drives, loading/unloading areas, and curb cuts and truck routes shall be submitted to the City Engineer for his approval. The City Engineer may, as a condition of approval of the Traffic Circulation Plan, restrict the size of trucks parked on the site or involved in deliveries and pickup. The City Engineer may also designate or restrict truck routes. d) The maximum gross floor area for any lot or premise shall be 5,000 square feet. e) Signs shall comply with the sign requirements for the NC, Neighborhood Commercial District. f) Industrial Performance Standard, as specified in Section 30-31 , will be applicable. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only.
