HomeMy WebLinkAboutORD 87-61 �� t �W '\ �•B rj ICj '� s ORDINANCE NO. 7- 41 ENTITLED AN ORDINANCE ESTABLISHING A TEMPORARY MORATORIUM UNTIL AUGUST 13, 1987, ON THE ISSUANCE OF ANY BUILDING PERMITS FOR ANY RESIDENTIAL CARE LAND USE INCLUDED IN THE 1972 SIC MANUAL, GROUP 836; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. WHEREAS, residential care land uses included in the 1972 Standard Industrial Classification Manual, Group No. 836, are presently allowed in commercial zones as a right and are being studied to determine whether these uses present impacts on adjoining land unlike those of other uses permitted in commercial zones; and, WHEREAS, such study and recommendation should be completed on or before August 12, 1987; and, WHEREAS, during the period of the study and recommendation, Council desires to prohibit the construction of such uses; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . There is hereby established a moratorium in the City of Beaumont on the issuance of building permits for any residential care land use which is presently included in the 1972 Standard Industrial Classification Manual, Group No. 836. This moratorium shall remain in effect and no building permits shall be issued for such uses until August 13, 1987. Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 3. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. PASSED BY THE CITY COUNCIL of the City of Beaumont this the -z2?S&) day of 1987.
