REPEAL. BE IT ORDAINED BY THE CITY OF BEAUI'ION` : Section 1 . That Chapter 11 , Article I, Section .011 s) (1 ) of the Code of Ordinances of the City of Beaumont be amen, °cl as follows: Section .011 (a) ( 1 ) : It shall be unlawful for any person to operat zi food service establishment within the City of Beauior.t:, or its police jurisdiction, who does not possess a valid permit, license, or certificate issued to him °'hei:- by the regulatory authority. Only a person who ,onij.,a_ies with the requirements of this ordinance shall bo entitled to receive or retain such a permit, i<(: !=nse, or certificate. Permits, licenses or certifi :at:E:!5 shall not be transferable from one person to inot.her person or place. A valid permit, license, or certificate shall be posted in every food serJic''EI� establishment. Permits, licenses, or certif i :,ai,_E�:'3 for temporary food service establishments shall b ;I_!E ::3ued for a period of time not to exceed fourteen ( ':I4 clays. A temporary food establishment permit may be s:suEa:d to any individual, business, or organization no 110".E-E! than four ( 4 ) times per calendar year (12 month peiAod) with the following exceptions: 1 ) There is no li. is t r-�n the number of times that a permit may be issued L; r temporary food events operating in connection w::t:ki a festival, involving organized public assembly for entertainment purposes; 2 ) A festival is def:i.nod, for the purposes of this policy, as a public celE5rati.on, entertainment or series of performances of a e,,,e::-t'ain kind, often held periodically. Section 2. That if any section, subsection, sentenco, clause or phrase of this ordinance, or the application of sane to a particular set of persons or circumstances, shoulc for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 3. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only.
