HomeMy WebLinkAboutORD 86-99 A ORDINANCE NO. 67 9 ENTITLED AN ORDINANCE AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ENACT A NEW WATER SERVICE RATE; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Chapter 28, Sections 28-50(a) , 28-50(c) , 28-50(e) and 28-50(g) of the Code of Ordinances of the City of Beaumont be, and the same are hereby, amended to read as follows: Section 28-50( a) : The following metered rate for water measured through meters approved by the Water Utilities Department shall be effective inside the city: Minimum monthly charge. . . . . . . . . . . . . . . . .$ 1 .23 A charge of One Dollar and Twenty-Eight Cents ($1 .28) per one thousand (1,000) gallons of water usage shall be made thereafter from zero (0 ) gallons to maximum monthly usage. Section 28-50(c) : Failure or refusal by any customer to pay any bill to the Water Department, or its authorized representatives, upon demand, shall constitute a breach of contract, and water and sewer service may, within ten ( 10) days from notice of such failure, be discontinued to the customer, and, at the discretion of the Director of Water Utilities, such services shall not be renewed until the customer has paid all delinquent bills, plus the following applicable service charges: r s + 1 (1) Field collection. . . . . . . . . . . . . . . . .$ 15.00 (2 ) Cut and seal. . . . . . . . . . . . . . . . . . . . . 20.00 (3 ) Seal broken. . . . . . . . . . . . . . . . . . . . . . 10.00 (4) Meter removed. . . . . . . . . . . . . . . . . . . . 30 .00 (5 ) Service killed at the main line. . 100.00 (6 ) Second trip on service turn on. . . 5 .00 (7 ) Change of name on account. . . . . . . . 5 .00 (8) Turn-on fee. . . . . . . . . . . . . . . . . . . . . . 10.00 (9) Return check . . . . . . . . . . . . . . . . . . . . . 15 .00 Section 28-50(e) : The Water Department, or its authorized agents, may require from any applicant for water service a cash deposit to secure payment of water, sewer and sanitation charges or any other charges that may accrue, and when such deposit is made it shall be not less than Seventy-Five Dollars ($75) ; provided, however, additional deposits may be required from any applicant to pay charges accrued or to accrue for the services. Failure to pay additional deposit will forfeit right to water, sewer and sanitation services and same may be discontinued five ( 5 ) days after notice to pay such additional deposit. Section 28-50(g) : Where water service is used by more than one dwelling unit by a single meter, or where dwelling units are not served by separate meters, a minimum charge of One Dollar and Twenty-Three Cents ( $1 .23) will be made for each dwelling unit served, and water used will be billed at the rate of One Dollar and Twenty-Eight Cents ( $1 .28) per thousand (1 ,000) gallons for all usage. Section 2 . That Section 28-53(a) and 28-53(b) of the Code of Ordinances of the City of Beaumont be, and the same are hereby, amended to read as follows: 2 - Section 28-53(a) : The following metered rates based upon water measured through meters approved by the Water Utilities Department shall be effected inside the city: There shall be a minimum monthly charge to all persons who have a sewer connection of One Dollar and Twenty-Three Cents ( $1 .23) . Sewer usage charges for residential and multi-family dwelling units shall be based on a return of eighty-seven percent (87%) of metered water. A charge of One Dollar and Twenty-Two Cents ( $1 .22) per thousand (1 ,000) gallons from zero (0) gallons to a maximum twenty thousand (20,000) gallon monthly usage. Sewer usage charges for commercial-industrial customers shall be based on one hundred percent ( 100%) of the metered water. A charge of One Dollar and Twenty-Two Cents ( $1 .22) per one thousand (1 ,000) gallons shall be made from zero (0) gallons to maximum monthly usage. Section 28-53(b) : Failure or refusal by any customer to pay any bill to the Water Department or its authorized representatives upon demand, shall constitute a breach of contract, and water and sewer service may, within ten ( 10) days from notice of such failure, be discontinued to the customer, and, at the discretion of the Director of Water Utilities, such service shall not be renewed until the customer has paid all delinquent bills, plus the applicable service charge as provided in Section 28-50. The notice of the user of failure or refusal to pay for sewer services shall provide for a hearing if requested by the user. A user may request a hearing concerning termination of sewer service and termination shall not occur until a determination of the merits of the user' s appeal is made by the person conducting the hearing. Section 3 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a 3 - � ��-9 i particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4 . That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only.
