HomeMy WebLinkAboutORD 87-19 ORDINANCE NO. X7-/1 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A RETAIL NURSERY/GROWER ON PROPERTY DESCRIBED AS TRACT 75, PLAT D-13 , a. WILLIAMS SURVEY, ab. 385, JEFFERSON COUNTY, TEXAS. WHEREAS, the Planning and Zoning Commission of the City of Beaumont considered the issuance of a specific use permit for a retail nursery/grower on property described as Tract 75, Plat D-13, A. Williams Survey, AB. 385, Beaumont, Jefferson County, Texas, to Roy D. Henslee, prospective buyer, his legal representatives, successors, and assigns for that certain property hereinafter described; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONTe Section 1 . That all conditions necessary for issuance of a specific use permit have been met and a specific use permit for a retail nursery/grower on property described as Tract 75, Plat D-13, A. Williams Survey, AB. 385 , Beaumont, Jefferson County, Texas, in accordance with Section 30-26 and Section 30-40 of the Code of Ordinances of the City of Beaumont, as amended, is hereby granted to Roy D. Henslee, prospective buyer, his legal representatives, successors and assigns for that certain tract described on Exhibit "A" attached hereto and made a part hereof for all purposes. Section 2 . That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B" and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. One ordinance would change the zoning from RS (Residential--Single Family) to RM-H (Residential Multiple Family-Highest Density) for about 4. 68 acres between the Shell Punt Farm at 2705 N. 10th Street and the 11th Street " Nursery at 2680 N. 11th Street .
