ENTITLED AN ORDINANCE AMENDING
CHAPTER 29, SECTION 29-49 OF THE
CODE OF ORDINANCES OF THE CITY OF
BEAUMONT; ESTABLISHING PARKING
REGULATIONS AND RATES FOR CITY PARKING
LOTS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL; PROVIDING FOR
PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 26 , Section 26-49 of the Code of
Ordinances of the City of Beaumont, as amended by Ordinance
Number 78-114, is hereby amended to read as follows:
Section 26-49: Parking Lots - Municipal Buildings
(a) Definitions. Except where the context
requires otherwise, as used in this Section,
the following terms shall have the meanings
respectively ascribed to them:
(1) South Lot. The City parking lot
fronting on the eastern side of Main
Street and located South of the Civic
Center-Municipal Office Building Complex.
(2) North Lot. The City parking lot
fronting on the eastern side of Main
Street and located North of the Civic
Center-Municipal Office Building Complex.
(b) No person shall park a vehicle in the south
lot between the hours of 7: 30 a.m. and 5 : 30 p.m. ,
Monday through Friday, unless such vehicle shall
have a City of Beaumont parking permit affixed
to the rear window thereof or unless such ve-
hicle shall be parked in an officialy desig-
nated visitor parking zone.
(c) The traffic engineer is authorized to estab-
lish visitor parking zones within the south lot.
(d) The City Manager is authorized to permit
�3ublic parking of vehicles in the south lot on
Saturday and Sunday and after 5: 30 p.m. Monday
through Friday and to establish rules and reg-
ulations therefor, including a rate not to
exceed $1. 00 per vehicle.
(e) The City Manager is authorized to establish
rules and regulations and to enter into agree-
ments for public parking in the north lot, in-
cluding rates not to exceed the following:
0 - 30 minutes $ 0. 25
30-60 minutes 0. 50
1 - 2 hours 1. 00
2 - 3 hours 1 . 25
3 - 4 hours 1. 50
4 - 5 hours 1. 75
Maximum (10 hours) 2. 50
Monthly 20. 00
Event Parking (night) 1. 00
(f) No person shall park a vehicle in the south
lot or the north lot other than within a clearly
marked parking space, nor shall any person park
a vehicle in an entrance, exit, driveway, or
aisle or in any manner which obstructs an entrance,
exit, driveway or aisle.
(g) In any prosecution charging a violation of
this section, proof that the particular vehicle
described in the complaint was parked in vio-
lation of this section together with proof that
the defendant named in the complaint was, at the
time of such parking, the registered owner of
such vehicle shall constitute in evidence a
rebuttable presumption that the registered owner
of such vehicle was the person who parked or
placed such vehicle in violation of this section.
Section 2.
Any person who violates any provision of this ordi-
nance shall, upon conviction, be punished as provided in Sec-
tion 1-8 of the Code of Ordinances of Beaumont, Texas.

Section 3.
That if any section, subsection, sentence, clause
or phrase of this ordinance, or the application of same to
a particular set of persons or circumstances, should for any
reason be held to be invalid, such invalidity shall not affect
the remaining portions of this ordinance, and to such end the
various portions and provisions of this ordinance are declared
to be severable.
Section 4 .
All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only.
