HomeMy WebLinkAboutORD 86-65 ORDINANCE NO. ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT FOR A SHOPPING CENTER ON PROPERTY LOCATED IN THE 3600 BLOCK OF LUCAS, BEAUMONT, TEXAS. WHEREAS, the Planning and Zoning Commission of the City of Beaumont considered the issuance of a specific use permit for a shopping center on property located in the 3600 Block of Lucas, Beaumont, Jefferson County, Texas, to Pat Phelan, owner, his legal representatives, successors, and assigns for that certain property hereinafter described; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That all conditions necessary for issuance of a specific use permit have been met and a specific use permit for a shopping center on property located in the 3600 Block of Lucas, Beaumont, Jefferson County, Texas, in accordance with Section 30-26 and Section 30-40 of the Code of Ordinances of the City of Beaumont, as amended, is hereby granted to Pat Phelan, owner, his legal representatives, successors and assigns for that certain tract described on Exhibit "A" attached hereto and made a part hereof for all purposes. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B" and made a part hereof for all purposes. Section 3 . Notwithstanding the site plan attached hereto, the use of the property hereinabove described shall be in all other respects subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. The director of planning may approve minor variations from the original permit which do not increase density, change traffic patterns, or result in any increase in external impact on adjacent properties or neighborhoods [Sec. 30-26 (i)]. The "amendment to site plan" submitted by Mark Whiteley & Associates, dated January 25, 1993, shows the entire site and addresses the requirements for a minor variation. This is a 2.24 acre tract out of Block 35, Calder Highlands Extension Addition on West Lucas Drive at Arthur Street. The applicant's letter of transmittal is dated January 26, 1993. The proposed drives and curb cuts on the site will not alter the traffic patterns. Overall building density has been reduced. The proposed Kwik Kar & Lube is situated on the tract between a future commercial building on the south side of the land and the existing store on the north side. Access will be from W. Lucas Drive. This proposal will not increase the external impact on the neighborhood. The proposal satisfies the requirements for approval of a minor variation to an approved specific use permit. A copy of this memorandum, if approved, will be sent to the City Clerk for filing with the original specific use permit. The original will be filed in the Planning Division.
