HomeMy WebLinkAboutORD 86-47 I 6 14 196 1 4 1 42 2565 ORDINANCE NO. - ENTITLED AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE THE SAID PROPERTY WITHIN THE CITY LIMITS, AND GRANTING THE SAID TERRITORY AND TO ALL FUTURE INHABITANTS THEREOF ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS; AND BINDING SAID FUTURE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF SAID CITY. WHEREAS, public hearings were held concerning the proposed annexation of the territory described in Exhibit "A" attached hereto for all purposes. Said public hearings were held on March 3 , 1986 and March 18, 1986. At the public hearings , all interested persons were provided an opportunity to be heard; and, WHEREAS, such public hearings were held not more than forty (40) days nor less than twenty ( 20) days prior to the institution of annexation proceedings ; and, WHEREAS, notices of such public hearings were published in the newspaper having general circulation in the City of Beaumont, Texas not more than twenty ( 20) nor less than ten ( 10) days prior to such hearings; and, WHEREAS, the territory lies adjacent to and adjoins the present boundaries of the City of Beaumont, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . THAT the land and territory lying adjacent to and adjoining the present boundaries of the City of Beaumont, Texas and described in i IQI 2 7666 Exhibit "A" attached hereto and made a part hereof for all purposes, is hereby added and annexed to the City of Beaumont, Texas; said territory shall hereinafter be included within the boundary limits of the City of Beaumont, Texas; the present boundary limits of such City at the various points contiguous to the area hereinafter described in Exhibit "A" , are altered and amended so as to include said area within the corporate limits of the City of Beaumont, Texas; such property shall be within Ward 4 for purposes of municipal elections. Section 2 . The described territory in the area so annexed shall be a part of the City of Beaumont, Texas, and the inhabitants thereof, if any, shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Beaumont, Texas. Section 3 . The Service Plan for such annexed area attached hereto as Exhibit "B" is hereby approved. PASSED BY THE CITY COUNCIL of the City of Beaumont on first reading this the ,yam day of 1986. THENCE west along said north right-of-way of Washington Boulevard a distance of 900 feet to a point marking the northwest corner of the tract described herein. THENCE turning south and at 65 feet crossing the south right-of-way line of Washington Boulevard and continuing south a total distance of 1420 feet along the western property line of Lot 4. Block 10., Wescalder Fig Acres; THENCE turning east along the southern orcoer --;) lines of ?:os-s 4 and 3; Block 10,. Exhibit "A" 14, 1 42 2569 March 12, 1986 TO: City Council and Planning Commission FROM: Planning and Economic Development Department SUBJECT: Service plan for proposed annexation of a 85.8 acre tract abutting the western Citv limits south of Washington Boulevard. Service Report The following basic scope of services will be provided upon annexation of the subject property; - Water Service. The subject property will be provided water service from the extension of a 12-inch water line to be extended from an existing line located approximately 180 feet to the east in Wash--'.,,ton Boulevard. - Sanitary Sewer Service. The subject property will be provided sanitary sewer service from the extension of a 10-inch sanitary sewer which is located approximately 240 feet to the east, in Washington. Boulevard. Extension of the water and sanitary sewer line discussed above will require demolition and reconstruction of Washington Boulevard in order to extend service across the beyond the L.h.V.A. Canal. These costs would be borne by the developer. - Storm Drainage. All developments within the proposed annexation area will be addressed according to specifications from the City Engineer's office. Storm runoff from all new development will be accepted into Willow Marsh Bayou which runs southward near the western boundary of the area pro- posed for annexation. - Solid Waste Collection. Solid waste collection will follow the normal pattern for commercial and residential areas. Exhibit "B" : 1012 ? The request is on the southwest side of the point at which Washington Boulevard crosses the LNVA Canal. Consequently in addition to annexing the canal, the City would need to construct a bridge, either indepen- dently or in conjunction with other governmental agencies, across Wash- ington Boulevard at this point. - Dedicated streets: Streets which will be dedicated by way of subdi- vision plat will be maintained by the City upon acceptance by the Director of Public Works as per the normal procedure. - Dedicated parks or playgrounds : Any lands intended to be dedicated for recreational purposes will receive individual review by the Director of Parks and Recreation as well as the Planning Department to see that theti- are consistent with the City's Comprehensive Park and Open Space Plan prior to their acceptance. - Street lights. Street lights in new platted subdivisions within the annexed area are to be provided at the developer's expense as per the requirements of the current Street Light Ordinance. The locations are determined by the Traffic Department in conjunction with Gulf States Utilities. - Fire and Police Protection. Fire protection for the subject property will come from Station #6, 1155 Glendale. Normal police protection would be provided by patrol units.
