HomeMy WebLinkAboutORD 86-20 ORDINANCE NO. - ,7-,-) ENTITLED AN ORDINANCE DESIGNATING A PART OF THE AREA LOCATED IN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF BEAUMONT AS AN INDUSTRIAL DISTRICT AS• AUTHORIZED BY THE MUNICIPAL ANNEXATION ACT; PROVIDING THE PURPOSE OF SUCH DISTRICT AND PROVIDING THAT SUCH DISTRICT SHALL BE KNOWN AS THE "CITY OF BEAUMONT INDUSTRIAL DISTRICT NO. 10" . WHEREAS, the "Municipal Annexation Act" , Article 9701, Vernon' s Texas Civil Statutes, authorizes a city to designate any part of the area located in its extraterritorial jurisdiction as an industrial district and to contract with the owners of land in such district guaranteeing the extraterritorial status of such district; and, WHEREAS, the City Council of the City of Beaumont deems it to be in the best interest of the City of Beaumont to designate the hereinafter described area an industrial district; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: 1 . That the area described in Exhibit "A" , attached hereto and made a part hereof, located within the extraterritorial jurisdiction of the City of Beaumont is hereby designated and established as an industrial district of the City of Beaumont. 2 . It is hereby declared to be the purpose of the City of Beaumont to treat with such area from time to time as the City © � --2-o -3- - � I Council of the City of Beaumont may deem to be in the best interest of the City of Beaumont and to contract with the owners of land in such industrial district guaranteeing the continuation of the extraterritorial status of such district for a period of time from April 1, 1986 until January 31, 1987. 3 . The industrial district created and established by this ordinance, and described herein, shall be known as the "City of Beaumont Industrial District No. 10" . 4. The City Manager is hereby authorized to execute an industrial district agreement with Texas Eastern Products Pipeline Company covering the property contained in said City of Beaumont Industrial District No . 10 for a term commencing April 1 , 1986 and ending January 3, 1987. Mayor - 2 - o �6.zo TEXAS EASTERN PRODUCTS PIPELINE COMPANY, A DIVISION OF TEXAS EASTERN TRANSMISSION CORPORATION (Beaumont Tank Farm) 103.89 acres of land, more or less, out of the Pelham Humphries League, Abstract No. 32, and a part of a tract of 379.49 acres , known as Tract 11-A in the partition of the Mc Faddin, Wiess, Kyle Land Company' s property as shown on the partition map thereof on file in the Map Records of Jefferson County, Texas, said 379.49 acre tract being the same land conveyed by W. W. Kyle to Yount-Lee Oil Company by deed dated August 2, 1926, and recorded in Volume 269, Page 537 of the Jefferson County Deed Records, said 103.89 acre tract being more particularly described by metes and bounds as follows: Beginning at the original furtherest south corner of said Tract 11-A, said corner being marked by a 2" iron pipe set in concrete; Thence N49 Deg. 28 min. W along the SW line of said Tract 11-A 4967.9 feet to a corner marked by a 2" iron pipe set in concrete; Thence N44 Deg. 56 min. E 148 feet to a stake for corner; same being the point of beginning of the tract here- with described; Thence N44 Deg. 56 min. E 143 feet to a 2" iron pipe for corner; Thence N27 Deg. 52 min. W 54.4 feet to a stake for corner, located under a wire fence; Thence N40 Deg. 23 min. E 2218.5 feet to a point; Thence S49 Deg. 28 min. E 1903.7 feet to a point; Thence S40 Deg. 23 min. W 2381 feet to a stake for corner; Thence N49 Deg. 28 min. W 1864.9 feet to the point of beginning and containing 103.89 acres, more or less, and being the same land described in deed dated December 31 , 1943, from Stanolind Oil Purchasing Company to Defense Plant Corporation, recorded in Volume 549, Page 73, of the Jefferson County Deed Records. W 1903.7 feet to the point of beginning, and containing 13,12 acres, more or less, and being the same land described in deed dated December 31 , 1943, from Stanolind Oil Purchasing Company to Defense Plant Corporation, recorded in Volume 549, Page 74 of the Jefferson County Deed Records.
