ENTITLED AN ORDINANCE REPEALING ORDINANCES 85-81 AND 85-90 AND ENACTING AN ORDINANCE CALLING A SPECIAL ELECTION FOR THE CITY OF BEAUMONT ON THE 5TH DAY OF NOVEMBER, 1985 FOR THE PURPOSE OF APPROVING OR REJECTING AN ORDINANCE CHANGING THE NAME OF MARTIN LUTHER KING, JR. PARKWAY AND OTHER STREETS REFERRED TO IN ORDINANCE 85-66 BACK TO THE ORIGINAL NAMES; APPROVING OR REJECTING AN ORDINANCE CHANGING THE NAME OF COLLEGE STREET TO MARTIN LUTHER KING,JR. BOULEVARD; CONCERNING THE RECALL OF THE MAYOR; CONCERNING THE RECALL OF COUNCILMAN G. WAYNE TURNER; CONCERNING THE REPEAL OF THE ORDINANCES ESTABLISHING RATES FOR GARBAGE, TRASH, WATER SERVICE, SEWER SERVICE AND, SANITATION FEES AND REGULATIONS; AN ORDINANCE PROVIDING THAT NO CITY EMPLOYEE SHALL RECEIVE A RATE OF PAY IN EXCESS OF $40,000 PER YEAR FOR THE NEXT FIVE (5 ) YEARS; AN ORDINANCE ESTABLISHING THE BEAUMONT MINIMUM WAGE LAW OF 1985 TO BRING THE MINIMUM WAGE OF THE CITY TO $4.10. WHEREAS, by Ordinances 85-81 and 85-90 a special election was called in the City of Beaumont for the 5th day of November, 1985; and, WHEREAS, various referendum, initiative and recall provisions have been certified to the City Council and should be added to the ballot; and, WHEREAS, all election items should be combined in this ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Ordinances 85-81 and 85-90 be, and the same are hereby, repealed. Section 2 . That it is hereby ordered that a special election be held on the 5th day of November, 1985 between the hours of 7 :00 a.m. and 7 :00 p.m. at which election various provisions shall be submitted to the qualified voters of the City for their action thereon as set out in the official ballot hereinafter prescribed. Section 3 . That the following ordinances be submitted to the electors of the City of Beaumont at an election to be held within the City of Beaumont on November 5 , 1985: BE IT ORDAINED BY THE CITY OF BEAUMONT: THAT SECTION I OF CHAPTER 23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BE AMENDED AND IN PARTICULAR THE NAME OF THAT CERTAIN STREET AS INDICATED UPON THE OFFICIAL STREET MAP OF BEAUMONT, TEXAS BY CHANGING THE NAME OF MARTIN LUTHER KING, JR. PARKWAY, AND OTHER STREETS REFERRED TO IN ORDINANCE 85-66 BACK TO THE ORIGINAL NAMES . BE IT ORDAINED BY THE CITY OF BEAUMONT: AN ORDINANCE REPEALING ORDINANCE 83-122 ESTABLISHING RATES FOR GARBAGE AND TRASH COLLECTION; ORDINANCE 84-127 AMENDING WATER AND SEWER RATES; AND 84-129 PROVIDING SANITATION FEES AND REGULATIONS. 2 - "AN ORDINANCE ESTABLISHING THE BEAUMONT MINIMUM WAGE LAW OF 1985 WHICH WILL BRING THE MINIMUM WAGE IN THE CITY TO $4. 10. /_7 FOR THE ORDINANCE /_7 AGAINST THE ORDINANCE Section 4. That the following recall questions shall be submitted to the electors of the City of Beaumont at an election to be held in the City of Beaumont on November 5, 1985; SHALL WILLIAM B . NEILD BE REMOVED FROM THE OFFICE OF MAYOR BY RECALL? SHALL G. WAYNE TURNER BE REMOVED FROM THE OFFICE OF COUNCILMAN BY RECALL? Section 5 . That notice of said election shall be given by publishing the notice set out herein in a newspaper of general circulation in the City and County one ( 1 ) time not more than twenty-five ( 25) days nor less than ten ( 10) days before said election. Said notice shall be in the following form: Notice of election in the City of Beaumont for the purpose of considering the following propositions: 1 ) Two ordinances, one of which changes the name of Martin Luther King, Jr . Parkway and other streets referred to in Ordinance 85-66 back to the original names and the other changes the name of College Street to Martin Luther King, Jr . Boulevard. 2) The question "Shall William B . Neild be removed from the office of Mayor by recall? " 3 - 3 ) The question "Shall G. Wayne Turner be removed from the office of Councilman by recall. " 4) An ordinance repealing Ordinance 83-122 establishing rates for garbage and trash collection; Ordinance 84-127 amending water and sewer rates; and Ordinance 84-129 providing sanitation fees and regulations. 5) An ordinance providing that no city employee shall receive a rate of pay in excess of $40,000 per year for the next five ( 5 ) years. 6 ) An ordinance establishing the Beaumont Minimum Wage Law of 1985 which will bring the minimum wage in the City to $4.10. NOTICE IS HEREBY GIVEN THAT AN ELECTION AS PROVIDED BY THE CHARTER OF THE CITY OF BEAUMONT WILL BE HELD IN THE CITY OF BEAUMONT, TEXAS ON THE 5TH DAY OF NOVEMBER, 1985 FROM 7 :00 A .M. TO 7 :00 P.M. TO CONSIDER THE PROPOSITIONS HEREIN SET OUT. Section 6 . The form of the ballot which shall be used at said election shall be substantially as follows: "AN ORDINANCE CHANGING THE NAME OF MARTIN LUTHER KING, JR. The special election hereby ordered shall be held under the provisions of the Charter of the City of Beaumont, Texas, and the Constitution and Laws of the State of Texas and the ordinances of the City of Beaumont, including this particular ordinance, and only qualified voters of and in the City of Beaumont shall be allowed to vote at said election, and each elector shall vote in the election precinct of his residence. Section 8 . The places for voting and the judges and officials at said election are set out in Exhibit "A" attached hereto and made a part hereof for all purposes. The presiding judges shall be authorized to select such clerks or other assistants provided by law, as may be deemed necessary; and said election shall be held in accordance with the provisions of law, and the general laws of the State of Texas shall be observed insofar as they are applicable. Section 9 . That an electronic voting system, as defined and described by Article 7 .15, Texas Election Code, shall be used for said election and the following are hereby appointed officers of said election to serve at the Central Counting Station, which is hereby established at the Jefferson County Mid-County Office Building: Manager of the Central Counting Station: Tom Lowrance Tabulation Supervisor: Raymond McInnis Presiding Judge for the Central Counting Station: Myrtle Corgey 6 - The Manager and Presiding Judge of the Central Counting Station shall appoint not more than four (4) clerks to serve at the Central Counting Station. The official ballot cards and ballot labels, respectively, for the election shall be prepared in accordance with the Texas Election Code. Absentee voting shall be conducted by a clerk for absentee voting, namely, Myrtle Corgey, the City Clerk, and the place at which the absentee voting shall be conducted is designated at the City Hall, Beaumont, Texas, which address in the mailing address to which absentee ballot applications and ballots voted by mail may be sent. Said clerk shall keep said office open for at least eight (8) hours, between 8 :00 a.m. to 5 :00 p.m. , on each day for absentee voting which is not a Saturday, a Sunday, or an official State holiday; provided, however, except as authorised by Article 5 .05, Subdivision 3 (d) , Texas Election Code, said clerk shall not permit anyone to vote absentee by personal appearance on any day which is not a regular working day for the clerk' s office, and under no circumstances shall she permit anyone to vote absentee by personal appearance at any time when her office is not open to the public. Absentee votes by mail shall be counted by a special canvassing board consisting of a Presiding Judge and two clerks. E . A. Adams is hereby appointed Presiding Judge of the special canvassing board and he shall appoint the two clerks. 7 - —9-�� � Section 10. A copy of this ordinance, both in the English language and in the Spanish language, signed by the Mayor of the City of Beaumont, Texas, and attested by the City Clerk of said City, shall constitute the notice ordering said election and the City Clerk is directed to cause a copy of this ordinance, signed by the Mayor and attested by her, to be posted at the City Hall in the City of Beaumont, Jefferson County, Texas, said posting to be not less than twenty (20) days prior to said election, and to cause a copy of this ordinance to be published on the same day in each of two (2 ) successive weeks in some newspaper of general circulation in the City of Beaumont, said publication to be made in accordance with the requirements of Article 1170, V .A.C.S . , Texas, the first such publication to be made not less than fourteen (14) days before the date of said election. Section 11. This ordinance shall be finally passed on the date of its enactment and shall take effect immediately upon its passage and signature by the Mayor.
