ENTITLED AN ORDINANCE CALLING A SPECIAL ELECTION OF THE CITY OF BEAUMONT ON THE 5TH DAY OF NOVEMBER, 1985 FOR THE PURPOSE OF APPROVING OR REJECTING AN ORDINANCE CHANGING THE NAME OF MARTIN LUTHER KING, JR. PARKWAY AND OTHER STREETS REFERRED TO IN ORDINANCE 85-66 BACK TO THE ORIGINAL NAMES; AND APPROVING OR REJECTING AN ORDINANCE CHANGING THE NAME OF COLLEGE STREET TO MARTIN LUTHER KING, JR. BOULEVARD. WHEREAS, a petition was submitted in the City and under the provisions of Article XI of the Charter of the City of Beaumont proposing the ordinances set forth in Section 2 below; and, WHEREAS, the City Clerk has certified to the City Council that the petition was signed by qualified electors equal in number to at least twenty-five percent ( 25% ) of the total number of votes cast at the last general municipal election; and, WHEREAS, in accordance with Chapter XI of the Charter of the City of Beaumont, the City Council has considered the petition and desires to submit the proposed ordinance to a vote of the people; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That it is hereby ordered that a special election be held on the 5th day of November, 1985 between the hours of 7 :00 a.m. and 7 : 00 p.m. , at which election an initiative petition shall be submitted to the qualified voters of the City for their action thereon as set out in the official ballot hereinafter prescribed. Section 2 . That the following ordinances be submitted to the electors of the City of Beaumont at an election to be held within the City of Beaumont on November 5 , 1985; BE IT ORDAINED BY THE CITY OF BEAUMONT: THAT SECTION I OF CHAPTER 23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BE AMENDED AND IN PARTICULAR THE NAME OF THAT CERTAIN STREET AS INDICATED UPON THE OFFICIAL STREET MAP OF BEAUMONT, TEXAS BY CHANGING THE NAME OF MARTIN LUTHER KING, JR. PARKWAY, AND OTHER STREETS REFERRED TO IN ORDINANCE 85-66 BACK TO THE ORIGINAL NAMES. BE IT ORDAINED BY THE CITY OF BEAUMONT: THAT SECTION I OF CHAPTER 23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BE AMENDED AND IN PARTICULAR THE NAME OF THAT CERTAIN STREET AS INDICATED UPON THE OFFICIAL STREET MAP OF BEAUMONT, TEXAS BY CHANGING THE NAME OF COLLEGE STREET TO MARTIN LUTHER KING, JR. BOULEVARD, EFFECTIVE IMMEDIATELY. Section 3 . That notice of said election shall be given by publishing said notices set out herein in a newspaper of general circulation in the city and county one time, not more than than twenty-five days ( 25) nor less than ten days ( 10) before said election. Said notice shall be in the following form: NOTICE OF ELECTION IN THE CITY OF BEAUMONT FOR THE PURPOSE OF CONSIDERING TWO ORDINANCES, ONE OF WHICH CHANGES THE NAME OF MARTIN LUTHER KING, JR. PARKWAY AND OTHER STREETS REFERRED TO IN ORDINANCE 85-66 BACK TO THE ORIGINAL NAMES AND THE OTHER CHANGES THE NAME OF COLLEGE STREET TO MARTIN LUTHER KING, JR. BOULEVARD. 2 - NOTICE IS HEREBY GIVEN THAT AN ELECTION, AS PROVIDED BY ARTICLE XI OF THE CHARTER OF THE CITY OF BEAUMONT, WILL BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 5TH DAY OF NOVEMBER, 1985 FROM 7 :00 A.M. TO 7 : 00 P. M. FOR THE PURPOSE OF APPROVING OR REJECTING TWO ORDINANCES. THE FIRST ORDINANCE CHANGES THE NAME OF MARTIN LUTHER KING, JR. PARKWAY AND THE OTHER STREETS REFERRED TO IN ORDINANCE 85-66 BACK TO THE ORIGINAL NAMES. THE SECOND ORDINANCE CHANGES THE NAME OF COLLEGE STREET TO MARTIN LUTHER KING, JR. BOULEVARD. Section 4 . The form of the ballot which shall be used in said election shall be substantially as follows: "AN ORDINANCE CHANGING THE NAME OF MARTIN LUTHER KING, JR. PARKWAY AND OTHER STREETS REFERRED TO ORDINANCE 85-66 BACK TO THE ORIGINAL NAMES. " FOR THE ORDINANCE AGAINST THE ORDINANCE "AN ORDINANCE CHANGING THE NAME OF COLLEGE STREET TO MARTIN LUTHER KING, JR. BOULEVARD. / FOR THE ORDINANCE AGAINST THE ORDINANCE 3 - Section 5 . The special election hereby ordered shall be held under the provisions of the Charter of the City of Beaumont, Texas, and the Constitution and Laws of the State of Texas and the ordinances of the City of Beaumont, including this particular ordinance, and only qualified voters of and in the City of Beaumont shall be allowed to vote at said election, and each elector shall vote in the election precinct of his residence. Section 6 . The places for voting and the judges and officials at said election are set out in Exhibit "A" attached hereto and made a part hereof for all purposes. The presiding judges shall be authorized to select such clerks or other assistants provided by law, as may be deemed necessary; and said election shall be held in accordance with the provisions of law , and the general laws of the State of Texas shall be observed insofar as they are applicable. Section 7 . That an electronic voting system, as defined and described by Article 7 . 15, Texas Election Code, shall be used for said election and the following are hereby appointed officers of said election to serve at the Central Counting Station, which is hereby established at the Jefferson County Mid-County Office Building: Manager of the Central Counting Station: Tom Lowrance Tabulation Supervisor: Raymond McInnis Presiding Judge for the Central Counting Station: Myrtle Corgey 4 - The Manager and Presiding Judge of the Central Counting Station shall appoint not more than four (4 ) clerks to serve at the Central Counting Station. The official ballot cards and ballot labels, respectively, for the election shall be prepared in accordance with the Texas Election Code. Absentee voting shall be conducted by a clerk for absentee voting, namely , Myrtle Corgey , the City Clerk , and the place at which the absentee voting shall be conducted is designated at the City Hall, Beaumont, Texas, which address is in the mailing address to which absentee ballot applications and ballots voted by mail may be sent. Said clerk shall keep said office open for at least eight ( 8 ) hours, between 8 :00 a.m. to 5 :00 p.m. , on each day for absentee voting which is not a Saturday, a Sunday, or an official State holiday; provided, however, except as authorized by Article 5 .05, Subdivision 3 (d) , Texas Election Code, said clerk shall not permit anyone to vote absentee by personal appearance on any day which is not a regular working day for the clerk' s office, and under no circumstances shall she permit anyone to vote absentee by personal appearance at any time when her office is not open to the public. Absentee votes by mail shall be counted by a special canvassing board consisting of a Presiding Judge and two clerks. E . A. Adams is hereby appointed Presiding Judge of the special canvassing board and he shall appoint the two clerks. 5 - Section 8 . A copy of this ordinance, both in the English language and in the Spanish language, signed by the Mayor of the City of Beaumont, Texas, and attested by the City Clerk of said City, shall constitute the notice ordering said election and the City Clerk is directed to cause a copy of this ordinance, signed by the Mayor and attested by her, to be posted at the City Hall in the City of Beaumont, Jefferson County, Texas, and at each of the polling places in each precinct of the City, said posting to be not less than twenty ( 20) days prior to said election, and to cause a copy of this ordinance to be published on the smae day in each of two ( 2 ) successive weeks in some newspaper of general circulation in the City of Beaumont, said publication to be made in accordance with the requirements of Article 1170, V.A.C.S . , Texas, the first such publication to be made not less than fourteen ( 14) days before the date of said election. Section 9 . This ordinance shall be finally passed on the date of its enactment and shall take effect immediately upon its passage and signature by the Mayor.
