ENTITLED AN ORDINANCE ORDERING A GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 6TH DAY OF APRIL, 1985, AS PROVIDED BY THE CHARTER OF THE CITY OF BEAUMONT, AND THE STATUTES OF THE STATE OF TEXAS, FOR THE PURPOSE OF ELECTING FOUR WARD COUNCILMEN; NAMING THE PRECINCTS AT WHICH THE ELECTION SHALL BE HELD; APPOINTING OFFICERS TO PRESIDE OVER SAID ELECTION; APPOINTING A CANVASSING BOARD FOR ABSENTEE VOTING; APPOINTING A MANAGER AND JUDGE OF THE CENTRAL COUNTING STATION; PROVIDING FOR NOTICE THEREOF; PROVIDING FOR JOINT ELECTION WITH THE BEAUMONT INDEPENDENT SCHOOL DISTRICT AND THE PORT OF BEAUMONT AND PROVIDING FOR SEVERABILITY. WHEREAS, under the provisions of the Charter of the City of Beaumont and the laws of the state of Texas relating thereto, a regular general municipal election is required to be held in the City of Beaumont on April 6 , 1985. The election shall be for Councilman for Ward One, Councilman for Ward Two, Councilman for Ward Three, and Councilman for Ward Four; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1 . That in accordance with the provisions of the Charter of the City of Beaumont and the .laws of the State of Texas relating thereto, there shall be held in the City of Beaumont on April 6 , 1985, a regular municipal election for said City for the purpose of electing a Councilman for Ward One, a Councilman for Ward Two, a Councilman for Ward Three, and a Councilman for Ward Four for said city. f - F5-If 02-/ 9- Ps- Section 2 . That legally qualified voters residing within the corporate limits of the City of Beaumont shall be entitled to a vote at said election. Section 3 . That said election shall be held in the City of Beaumont at the places listed in Exhibit "A" attached hereto and made a part hereof for all purposes and the persons whose names appear in said Exhibit "A" are appointed presiding judges and alternates for their respective voting boxes, with the authority to select and appoint their own clerks. (See Exhibit "A" ) The presiding judge for each election precinct shall appoint two clerks and as many additional clerks as he deems necessary for the proper conduct of the election, provided that not more than a total of five ( 5 ) clerks shall be appointed for any election precinct. Clerks shall be selected from different political parties when practicable. Section 4 . That said election shall be held under, and the qualifications of those voting thereat shall be controlled by , the provisions of the Texas laws governing elections. Section 5 . That notice of said election shall be given by publishing said notice as set out herein in a newspaper of general circulation in this City and County one time, not more than twenty-five ( 25) 2 4_ 5/ days or less than ten ( 10) days before said election. Said Notice shall be in the following form: "NOTICE OF THE GENERAL MUNICIPAL ELECTION IN THE CITY OF BEAUMONT FOR THE PURPOSE OF ELECTING FOUR WARD COUNCILMEN. " "Notice is hereby given that the General Municipal Election as provided by the Charter of the City of Beaumont and the Statutes of the State of Texas will be held in the City of Beaumont, Texas, on the 6th day of April, 1985, from 7 :00 A.M. to 7 :00 P.M. , for the purpose of electing four Ward Councilmen. " A copy of said notice shall be filed with the County Clerk at Jefferson County , Texas, and another copy shall be posted on a bulletin board in the office of said County Clerk at least twenty ( 20) days prior to the election. Section 6 . The form of ballot which shall be used in said General Municipal Election shall be substantially as follows: GENERAL ELECTION CITY OF BEAUMONT JEFFERSON COUNTY, TEXAS APRIL 6 , 1985 OFFICIAL BALLOT FOR COUNCILMAN WARD I (Vote for one) FOR COUNCILMAN WARD II (Vote for one) FOR COUNCILMAN WARD III (Vote for one) FOR COUNCILMAN WARD IV (Vote for one) 3 - Section 7 . In accordance with the laws of the State of Texas, Tom Jones and Bill Masters are hereby appointed Presiding Judges of the Central Counting Station, Tom Lawrence is hereby appointed Manager of said Central Counting Station, and Raymond McInnis is hereby appointed Tabulation Supervisor. Section 8 . (A) That in accordance with the laws of the State of Texas, an electronic voting system shall be used at said election for voting on the day of election and for the casting of absentee votes by personal appearance. (B) In accordance with the Texas Election Code, Myrtle Corgey is hereby appointed clerk for absentee voting. The clerk for absentee voting shall keep her offices at said locations open during such hours on each day for absentee voting which is not a Saturday , a Sunday , or an official State holiday . Absentee voting by mail shall be at the City Clerk' s Office, City of Beaumont, (City Hall) , P. O. Box 3827, Beaumont, Texas, 77704. Voters may vote absentee at the above location. (C) Absentee votes by mail shall be counted by a special canvassing board consisting of one presiding judge and two clerks. E . A. Adams is hereby appointed presiding judge of the special canvassing board and he shall appoint two clerks. (D) In order to prevent the casting of more than one absentee ballot, absentee judges are directed to retain the voter registration certificate of each absentee voter and to return the 4 - same by mail immediately following the election to the address designated by such voter. Section 9 . That the election shall be held jointly with the Trustee Election of the Beaumont Independent School District and Port of Beaumont, in the election precincts set forth in Exhibit "A" attached hereto and made a part hereof for all purposes, in accordance with the following terms of agreement between the Beaumont Independent School District, the City of Beaumont and the Port of Beaumont: (A) The expenses of the election within joint precincts shall be divided with the City of Beaumont paying that part of said expenses represented by a ratio of the number of voters voting in the city election to the total number of voters voting in the school district, the municipal election and the Port of Beaumont election in said joint precincts. (B) Single ballot forms shall be used which shall contain the Councilmen positions, BISD Board of Trustees, and Commissioners for Port of Beaumont to be voted upon and all propositions which may be required by the city as well as the officers and propositions required by the school district and Port of Beaumont. (C) The herein named election officers shall conduct the city , the School District and Port of Beaumont elections in said election precincts. (D) Records for all elections shall be combined. - 5 - (E) One set of ballot boxes and stub boxes for all elections shall be used. (F) Election returns shall be made on joint forms but the City Council of the City of Beaumont shall canvas the returns of the general municipal election. (G) The City Clerk of the City of Beaumont is designated custodian of all records and of the voted ballots. Section 10 . That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular person, or to a particular set of circumstances, should for any reason be held invalid, such invalidity shall in no way affect the remaining portions of this ordinance and to such end the various portions and provisions of this ordinance are declared to be severable.
