ORDINANCE NO.
ENTITLED AN ORDINANCE CLOSING A PORTION OF
WALNUT STREET RIGHT-OF-WAY FROM MAIN STREET TO
MULBERRY STREET; PROVIDING FOR SEVERABILITY.
WHEREAS, it has been requested that the portion of Walnut
Street located between Main and Mulberry Streets be closed for the
completion of a landscaped plaza by the Enterprise Company; subject
to retention of an easement to provide for future maintenance;
and,
WHEREAS, the City Council is of the opinion that closing
that portion of Walnut Street for completion of a park-like plaza
by the Enterprise Company will enhance the surrounding landscape;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1 .
THAT the portion of Walnut Street right-of-way located between Main
and Mulberry Streets be closed for additional landscaping by the
Enterprise Company subject to retention of an easement to provide
for future maintenance.
Section 2 .
That if any section, subsection, sentence, clause or
phrase of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
