ENTITLED AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE THE SAID PROPERTY WITHIN THE CITY LIMITS, AND GRANTING THE SAID TERRITORY AND TO ALL INHABITANTS THEREOF ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS; AND BINDING SAID INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF SAID CITY. WHEREAS, two ( 2 ) public hearings were held concerning the proposed annexation of the territory described in Exhibit "A" attached hereto for all purposes. Said public hearings were held on March 19 , 1984 and April 16, 1984. At the public hearings , all interested persons were provided an opportunity to be heard; and, WHEREAS, such public hearings were held not more than forty ( 40) days nor less than twenty ( 20) days prior to the institution of annexation proceedings ; and, WHEREAS, notices of such public hearings were published in the newspaper having general circulation in the City of Beaumont, Texas not more than twenty ( 20) nor less than ten ( 10) days prior to such hearings ; and, WHEREAS, the territory lies adjacent to and adjoins the present boundaries of the City of Beaumont, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT the land and territory lying adjacent to and adjoining the present boundaries of the City of Beaumont, Texas and described in . 2 80 8887 Exhibit "A" attached hereto andi "made-.' a part hereof for all purposes, is hereby added and annexed to the City of Beaumont, Texas; said territory shall hereinafter be included within the boundary limits of the City of Beaumont, Texas; the present boundary limits of such City at the various points contiguous to the area hereinafter described in Exhibit "A" , are altered and amended so as to include said area within the corporate limits of the City of Beaumont, Texas; such property shall be within Ward 2 for purposes of municipal elections. Section 2. The described territory in the area so annexed shall be a part of the City of Beaumont, Texas, and the inhabitants thereof, if any , shall be entitled to all the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Beaumont, Texas. Section 3. Chapter 10, Section 10-21 of the Code of Ordinances of the City of Beaumont is hereby amended to add 120. 4 acres to be the property hereinafter described in Exhibit "A" attached hereto and made a part hereof for all purposes. LOCATION OF PROPERTY: Beginning at the intersection of Florida Avenue and the Beaumont city limits line and extending west for 3950 feet. PROPERTY DESCRIBED AS FOLLOWS : A 120 .4 acre tract out of the J. A. Veatch Survey; for locative corner BEGIN at the intersection of Florida Avenue and the Beaumont city limit line, said intersection occurring approxi- mately 550 feet west of Highways 69 , 96 , and 287 to the POINT OF BEGINNING; THENCE extending west a distance of approximately 3950 feet to a point on the common line of the J. A. Veatch and James Rowe Surveys; THENCE turning due south for a distance of 500 feet along said common line; THENCE due east for a distance of 650 feet; THENCE turning southeast and following the west bank of the relocated LNVA Canal for a distance of 3900 feet to a point; THENCE turning north for a distance of 300 feet to a point and intersecting with the Beaumont city limits line; THENCE continuing north along said city limit line a distance of 2200 feet to a point marking the intersection of Florida Avenue and the Beaumont city limits line, the same being the POINT OF BEGINNING of the hereinabove des- cribed tract containing 120. 4 acres of land, more or less. i'xhibit "A" t2 8 0 0O April 16 , 1984 Council Letter No. Honorable Mayor and Members of City Council Subject: Annexation of 120 . 4 acres located at the intersection of Florida Avenue and the Beaumont City Limits line. Should the subject land be annexed, the following basic scope of services would be provided: - Water Service. The subject property would be provided with water service from the extension of a 6 and 8-inch water line to be extended from existing lines located in Florida Avenue. - Sanitary Service. The subject property would be provided sanitary sewer service from a 36-inch force main which would tie to existing facilities within the city limits. - Storm Drainage. All developments within the proposed annexation area will be addressed according to specifications from the City Engineer ' s office. Storm runoff from all new development will be accepted into the Usan Street ditch which runs southward towards Cardinal Drive then south within the proposed annexation site. Additional storm drainage for the proposed landfill site will occur from an existing ditch running north/south along the eastern boundary of the sewage treatment plant. - Solid Waste Collection. Solid waste collection will follow the normal pattern for commer- cial areas. - Fire Protection. Fire protection would be provided by Stations #3 and #10 at Ken- ' neth and Brockman and 3855 Washington Boulevard, respectively. Police Protection. Normal police patrol service will be provided for the annexed property. This area falls into police patrol districts 4 and 5. °-F�4 Exhibit "B,, d 6e .. _ Page 2 01 Maintenance of Publicly Dedicated Community Facilities. Dedicated Streets : Streets which will be dedicated by way of subdivision plat will be maintained by the City upon acceptance by the Director of Public Works as per the normal procedure. Dedicated parks or playgrounds : Any lands intended to be dedicated for recreational purposes will receive individual review by the Director of Parks and Recreation as well as the Planning Depart- ment to see that they are consistent with the City' s Comprehensive Park and Open Space Plan prior to their acceptance . Street Lights . Street lights in new platted subdivisions within the annexed area are to be provided at the developer's expense as per the re- quirements of the current Street Light Ordinance. The locations are determined by the Traffic Department in conjunction with Gulf States Utilities. PLANNING COMMISSION RECOMMENDATION The Planning Commission recommended approval of the annexation by a vote of 5 to 0 . Karl Nollenberger City Manager cc: Sherell J.
