ENTITLED AN ORDINANCE AMENDING CHAPTER 21, ARTICLE I, SECTION 21-9 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT; ESTAB- LISHING PERSONAL LEAVE AND SHORT-TERM DISABILITY LEAVE FOR CITY EMPLOYEES AND ESTABLISHING APPLICABLE TERMS AND CONDITIONS; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Chapter 21 , Article I , Section 21-9 of the Code of Ordinances of the City of Beaumont, be, and the same is hereby , amended by repealing the existing Section 21-9 and enacting a new Section 21-9 in lieu thereof , which said new Section 21-9 shall read as follows: Section 21-9. Personal Leave, Short-Term Disability Leave. (A) Each regular full-time employee of the city shall earn personal leave which may be used for illness or, upon the supervisor' s approval, for any purpose. Each eligible employee shall earn 2. 15 hours of personal leave each biweekly pay period. No employee who is paid for fewer than 80 hours in a biweekly pay period shall earn personal leave for that pay period. Unused personal leave may be accumulated based upon length of service. An employee with fewer than eleven ( 11) years' service may accumulate a i maximum of 160 hours personal leave. An employee with eleven ( 11) or more years' service may accumulate an additional 32 hours personal leave for each year of service over ten ( 10) . An employee may not accumulate more than 720 hours of personal leave. An employee with more than one year of service who leaves employment in good standing shall be paid for all accumulated personal leave upon termination. (B) Each regular full-time employee of the city shall earn short-term disability leave. Each eligible employee shall earn 3.69 hours of short- term disability leave each biweekly pay period. No employee who is paid for fewer than 80 hours in a biweekly pay period shall earn short-term disability leave for that pay period. An employee may use disability leave after being absent 80 hours for the same illness or disability. Certification of illness or disability by the city physician may be required. Accumulation of short-term disability leave credits shall be unlimited. (C) Employees who have accumulated sick leave under Section 21-9 of the Code of Ordinances as it existed prior to the effective date of this - 2 - I ordinance shall retain such accumulated sick leave. All such accumulated sick leave, not to exceed 120 hours, shall be credited to personal leave pursuant to Section 21-9(A) of this ordinance. All such accumulated sick leave in excess of 120 hours, but not to exceed 360 hours, shall be credited to short-term disability leave pursuant to Section 21-9(B) of this ordinance. All such accumulated sick leave in excess of 480 hours shall be credited as follows: 25% to personal leave pursuant to Section 21-9(A) of this ordinance and 75% to short-term disability leave pursuant to Section 21-9( B) of this ordinance; provided that the total amount of such accumulated sick leave credited to personal leave shall not exceed the total amount of personal leave which may be accumulated pursuant to Section 21-9(A) of this ordinance. If the amount of such accumulated sick leave to be credited to personal leave exceeds the amount of personal leave which may be accumulated, the balance shall be credited to short-term disability leave pursuant to Section 21-9( B) of this ordinance. City employees with fifteen ( 15) or more years of creditable service who are sixty ( 60) years of age or older, or who retire under the Texas - 3 - Municipal Retirement System or the Beaumont Fire- men' s Pension Fund, shall be paid upon termination for all accumulated personal leave and for all sick leave accumulated prior to April 1 , 1984, that is credited to short-term disability leave pursuant to this section; provided that the total payment shall not exceed 720 hours. (C) Upon death of any city employee eligible for payment of accumulated personal leave or accumulated sick leave, the employee' s estate shall be paid a sum equal to the amount which the employee would have been paid if the employment had terminated on the date of death. Section 2. This ordinance shall be effective on and after April 1 , 1984. Section 3 . That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 4 . That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall in no wise affect the 4 - remaining portions of this ordinance, and to such end the provisions of this ordinance are declared to be severable.
