HomeMy WebLinkAboutORD 83-89 g` . AGE 8325456 ! 00311039 ORDINANCE NO. ENTITLED AN ORDINANCE CANVASSING THE RETURNS OF THE ELECTION HELD IN THE CITY OF BEAUMONT ON THE 13TH DAY OF AUGUST, 1983. WHEREAS, the City Council of the City of Beaumont duly called an election to be held on the 13th day of August, 1983 for the purpose of voting on propositions to amend the City Charter; propositions concerning the sale of Morgan Park and Spindletop Park; and a proposition concerning changing the name of M . L. King Drive to Fourth Street; and, WHEREAS, the election was duly conducted on the 13th day of August, 1983, at which the qualified voters of the City of Beaumont casts ballots on the following propositions: Proposition No. 1 Shall Section 5 of Article I of the Charter of the City of Beaumont be repealed and shall Section 2 of Article III and Sections 4 and 6 of Article IV of the Charter of the City of Beaumont be amended to provide for six (6 ) Councilmembers and a Mayor each of whom shall serve for two ( 2 ) year terms with four (4 ) Councilmembers to reside in designated wards , to be elected by a majority of the qualified voters who shall reside only within the boundaries of the designated wards , two ( 2) Councilmembers to be elected at-large by a plurality of the qualified voters of the City, and a Mayor who shall be elected at-large by a majority of the qualified voters of the City Making a total of seven ( 7 ) d'=/,./ k3 100- 31 1040 persons to serve on the City Council; and further changing provisions of the Charter of the City of Beaumont relating to the total number of Councilmembers and the number of Councilmembers required for action in certain cases, by amending Sections 3 , 7 and 8 of Article III of the Charter of the City of Beaumont? Proposition No. 2 If Proposition No. 1 above is approved by the qualified voters of the City, shall Section 2 of Article III of the Charter of the City of Beaumont be further amended to provide that the City Council shall be elected for staggered terms ; so that Section 2 of Article III of the Charter of the City of Beaumont will provide that at the election held in 1984, the ward Councilmembers shall be elected for a term of one ( 1 ) year and the Mayor and Councilmembers-at-large shall be elected for a term of two ( 2 ) years; thereafter, the Mayor and all Councilmembers shall be elected for two ( 2 ) year terms . Proposition No. 3 Proposed that 64.8 acres, more or less, out of the Hezekiah Williams Survey, known as Morgan Park , shall be sold for cash. All monies acquired in said sale shall be used for the acquisition and improvement of parks for the City of Beaumont. Proposition No. 4 Proposed that 16 acres, more or less, out of the John A. Veatch Survey, known as Spindletop Park , shall be sold for cash. All monies acquired in said sale shall be used for the acquisition and improvement of parks for the City of Beaumont. 2 - AGENDA ITEM C=) No_ 9 C Proposition No. 5 W That Section 1 of Chapter 23 of the Code of Ordinances CD of the City of Beaumont, Texas be amended and in particular the name of that certain street as indicated upon the official map of Beaumont, Texas by changing the name of M. L. King Drive to Fourth Street, effective immediately; and, WHEREAS, after duly canvassing said returns, the City Council found that the votes cast at said election for the several propositions were as follows: Proposition No . 1 YES 7 ,725 NO 5 ,560 Proposition No. 2 YES 8 ,745 NO 5,559 Proposition No. 3 FOR 9 ,590 AGAINST 3 ,803 Proposition No . 4 FOR 8 ,775 AGAINST 4 ,214 Proposition No . 5 FOR 9 , 185 AGAINST 6 ,224 NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That the City Council finds that the election held in and throughout the City of Beaumont, Texas on the 13th Day of August, 1983, which election is more particularly described in the preamble of this ordinance, was duly called and notice thereof was given and said election was held under and in strict conformity with law; that only duly qualified resident electors of said City voted at said election; that due returns of said election have been made by the proper officers; and, that said election has resulted in the following outcome: 3 - 0���� M ICU 3I 10 Proposition No. 1 PASSED Proposition No. 2 PASSED Proposition No . 3 PASSED Proposition No. 4 PASSED Proposition No . 5 PASSED Section 2 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable.
