ORDINANCE AUTHORIZING,_ RATIFYING, APPROVING AND
CONFIRMING PUBLICATION OF NOTICE OF INTENTION
TO ISSUE AND . SELL CERTIFICATES OF OBLIGATION
WHEREAS , the City Council of City of Beaumont, Texas ,
has heretofore found and determined that it was necessary
and desirable to authorize , issue , sell and deliver its
certificates of obligation in the maximum amount of
$1 , 700, 000 , and has caused notice of such intention to be
published in the Beaumont Enterprise; and
WHEREAS , the City Council has now found and determined
that such amount is insufficient to accomplish the purposes
set out in such Notice; and
WHEREAS , the City Council hereby affirmatively finds
and determines , that it is necessary and desirable for the
City to authorize, issue, sell and deliver the certificates
of obligation in the maximum amount of $2 , 350, 000 , as
described in the attached Notice, and the City Council
hereby declares its intention to authorize the issuance of
such certificates of obligation at a meeting of the City
Council to be held at the time and place described in the
attached Notice; and
WHEREAS, the City Clerk of the City of Beaumont, Texas,
has caused Notice of Intention to Issue and Sell Certifi-
cates of Obligation to be published in the Beaumont Enter-
prise on July 30 , 1983 , and such notice is to be published
again on August 6, 1983; and
WHEREAS , the City Council wishes to authorize, approve,
ratify and confirm the publication of notice of the City' s
intention to issue and sell such certificates of obligation;
Now, Therefore
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 . That the facts and recitations contained
in the preamble of this ordinance are hereby found and
declared to be true and correct.
Section 2. That the City Council hereby authorizes,
ratifies , approves and confirms the action of the City Clerk
of causing to be published in the manner required by law a
notice of intention to issue and sell certificates of
obligation in substantially the form attached hereto.
Section 3 . That the Notice of such sale.. in
substantially the form attached hereto shall be published in__
English and Spanish in the Beaumont Enterprise, which is a
newspaper published and having general circulation in the
City , at least once a week for two consecutive weeks prior
to the date of the meeting of the City Council at which the
issuance of the certificates of obligation is to be
authorized, with the date of the first publication to be not
later than at least fourteen (14) days prior to the
aforesaid meeting.
Section 4 . That it is hereby officially found and
determined that a case of emergency or urgent public neces-
sity exists which requires the holding of the meeting at
which this ordinance is passed, such emergency or urgent
public necessity being that the proceeds from the sale of
the proposed certificates of obligation are required as soon

as possible without delay for necessary and urgently needed
public improvements, and that said meeting was open to the
public as required by law, and public notice of the date,
hour, place and purpose of said meeting was given, all as
required by Article 6252-17 , Vernon ' s Texas Civil Statutes ,
as amended.
Section 5. That this ordinance shall be effective
and in full force and effect after its passage.
ADOPTED AND APPROVED this 2nd day of August, 1983.

NOTICE OF INTENTION TO ISSUE AND SELL
CERTIFICATES OF OBLIGATION
NOTICE IS HEREBY GIVEN that the City Council of the CITY
OF BEAUMONT, Texas, will meet at the Council Chambers, City
Hall, Beaumont, Texas, at 1 :15 p.m. on the 16th day of August,
1983, at which meeting it tentatively intends to adopt an
ordinance authorizing the issuance and sale for cash of the
City' s certificates of obligation, payable from ad valorem
taxation and from certain revenues of the City' s swimming
pools, in the maximum amount of $2 ,350 ,000, bearing interest
at a rate not in excess of that prescribed by Article 717k-2 ,
V.T.C .S . , as amended, and maturing over a period of years not
to exceed 40 years from the date thereof, for the purpose of
evidencing the indebtedness of said City for all or any part
of the cost of acquiring and constructing public works for
said City, to-wit: permanent sanitary landfill facilities,
and for all or any part of the cost of acquiring equipment for
said sanitary landfill.
