Og-fA ENTITLED AN ORDINANCE CALLING AN ELECTION IN THE CITY OF BEAUMONT FOR THE 13TH DAY OF AUGUST, 1983, FOR THE PURPOSE OF APPROVING OR REJECTING AN ORDINANCE CHANGING THE NAME OF M . L. KING DRIVE TO FOURTH STREET AND PROVIDING FOR SEVERABILITY. WHEREAS, by Ordinance No. 82-2 , adopted January 5 , 1982 the City of Beaumont changed the name of Fourth Street to M . L. King Drive effective January 15 , 1984 ; and, WHEREAS, a petition was submitted to the City under the provisions of Article XI of the Charter of the City of Beaumont proposing the ordinance set forth in Section 1 below; and, WHEREAS, the City Clerk has certified to the City Council that the petition was signed by qualified electors equal in number to at least twenty-five percent ( 25%) of the total number of votes cast at the last general municipal election; and, WHEREAS, in accordance with Chapter XI of the Charter of the City of Beaumont, the City Council has considered the petition and desires to submit the proposed ordinance to a vote of the people; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That the following ordinance be submitted to the electors of the City of Beaumont at an election to be held within the City of Beaumont on August 13, 1983: "ENTITLED AN ORDINANCE CHANGING THE NAME OF M . L. KING DRIVE TO FOURTH STREET. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . That Section 1 of Chapter 23 of the Code of Ordinances of Beaumont, Texas, be amended and in particular the name of that certain street as indicated upon the official map of Beaumont, Texas by changing the name of M . L. King Drive to Fourth Street, effective immediately" . 0- 83- 9 7 9 - �s Section 2 . That notice of said election shall be given by publishing said notice as set out herein in a newspaper of general circulation in this city and county one time, not more than twenty-five ( 25) days nor less than ten ( 10) days before said election. Said notice shall be in the following form: "NOTICE OF ELECTION IN THE CITY OF BEAUMONT FOR THE PURPOSE OF APPROVING OR REJECTING AN ORDINANCE TO CHANGE THE NAME OF M . L. KING DRIVE TO FOURTH STREET. NOTICE IS HEREBY GIVEN THAT AN ELECTION AS PROVIDED BY ARTICLE XI OF THE CHARTER OF THE CITY OF BEAUMONT WILL BE HELD IN THE CITY OF BEAUMONT, TEXAS ON THE 13TH DAY OF AUGUST, 1983, FROM 7 : 00 A.M. TO 7 : 00 P.M . FOR THE PURPOSE OF' APPROVING OR REJECTING AN ORDINANCE TO CHANGE THE NAME OF M . L. KING DRIVE TO FOURTH STREET. " Section 3 . The form of ballot which shall be used in said election shall be substantially as follows: "AN ORDINANCE TO CHANGE THE NAME OF M . L. KING DRIVE TO FOURTH STREET. FOR THE ORDINANCE AGAINST THE ORDINANCE Section 4 . That Sections 1 , 3 , 4 , 6 , 7 and 8 of Ordinance 83-64, adopted by the City Council on June 21, 1983, relating to the legal qualifications of voters, election places and presiding judges and clerks, adoption of state laws governing elections, appointing officials of the central counting station, and adoption of an electronic voting system and absentee voting provisions are 2 - hereby adopted and incorporated herein by reference and shall govern the election called by this ordinance. Section 5 . That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular person, or to a particular set of circumstances, should for any reason be held invalid, such invalidity shall in no way affect the remaining portions of this ordinance and to such end the various portions and provisions of this ordinance are declared to be severable.
