ENTITLED AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 13TH DAY OF AUGUST, 1983, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY OF BEAUMONT PROPOSITIONS FOR THE AMENDMENT OF THE CITY CHARTER AND THE QUESTIONS WHETHER THE CITY OF BEAUMONT SHALL BE AUTHORIZED TO SELL MORGAN PARK AND SPINDLETOP PARK ; PROVIDING FOR PLACES WHERE SUCH ELECTION SHALL BE HELD; PROVIDING FOR THE HOLDING OF SUCH ELECTION, INCLUDING THE NAMING OF OFFICIALS TO CONDUCT SUCH ELECTION; SETTING FORTH THE PROPOSITIONS TO BE VOTED ON; PROVIDING FOR NOTICE; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR FINAL PASSAGE. WHEREAS, the City Council, on its own motion, desires to to submit to the qualified voters of the City of Beaumont at a special election certain proposed amendments to the City Charter, and two propositions concerning the sale of two city parks and to give proper and legal notices by publication as provided by law; and, WHEREAS, the Charter of ,the City of Beaumont has not been altered or amended within two years next preceding the date set in this ordinance for the holding of the election on the propositions herein; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEA70MONT: Section 1 . That it is hereby ordered that a special election be held on the 13th day of August, 1983, between the hours of 7 :00 a.m, and 7 : 00 p.m. , at which election propositions for proposed amendments to the Charter of the City of Beaumont and for the sale of two parks shall be submitted to the qualified voters of the City for their action thereon as set out in the official ballot hereinafter prescribed. Section 2 . That the official ballot for the registering of the "YES" and "NO" vote of the voters voting on the propositions shall be as set out in Section 5 hereof. The proposed amendments to the City Charter are as follows: d— ?3_ / V (A separate number is assigned for convenience in reference to each subject for which an amendment is proposed. ) Amendment No. 1 Section 5 of Article I of the Charter of the City of Beaumont shall hereafter be repealed. Amendment No. 2 Section 6 of Article I of the Charter of the City of Beaumont shall hereafter read as follows: "Section 6--CHANGE OF WARD BOUNDARIES: The City Council shall have power to establish, alter or change the ward boundaries of the City of Beaumont; and to divide the City into wards , designating the same by number and describing same; provided that there shall at all times be four ( 4 ) wards within the City; and to change such wards from time to time as the City Council may deem expedient so that each ward shall contain as nearly as possible the same number of electors. " Amendment No. 3 Section 2 of Article III of the Charter of the City of Beaumont shall hereafter read as follows: "Section 2--NUMBER AND TERM: The City Council shall be composed of a Mayor and six (6 ) Councilmembers. Four ( 4 ) Councilmembers shall be designated as ' ward Councilmembers' , each of whom shall be elected only by the qualified voters residing in the ward from which each such ward Councilmember is elected. Each ward councilmember shall reside in the ward which he is elected to represent. Two ( 2 ) councilmembers shall be designated ' Councilmembers-at-large' ; and the Mayor and Councilmembers-at-large shall be elected by all the qualified voters of the City. The term of office shall be for two ( 2 ) years and until their respective successors are elected and qualified" . Amendment No. 4 Section 4 of Article IV of the Charter of the City of Beaumont shall hereafter read as follows: "Section 4--ELECTION BY MAJORITY, VOTING AT LARGE, RUNOFF ELECTION: The candidate for Mayor receiving the majority of the votes cast by the qualified voters of the City for Mayor shall be declared elected. The two ( 2 ) candidates for Councilmember-at-large receiving the greatest number of votes cast by the qualified voters of the City for Councilmember-at-large shall be declared elected; it being the intention of this section that the Councilmembers-at-large shall be elected by a plurality rather than a majority of the votes. Each qualified voter shall be entitled, but shall not be required, to vote for two ( 2 ) candidates for Councilmember-at-large. The candidate for ' ward Councilmember' receiving the majority of votes cast by the qualified voters residing in the ward shall be declared elected; it being the intention of this section that each ward as it may hereafter exist shall have equal representation on the Council, but that the four (4 ) ward Councilmembers shall be voted upon only by the qualified voters residing in each of the four ( 4 ) wards established by the City Council as provided in Article I of this Charter. If no candidate for Mayor or for ward Councilmember receives a majority of all votes cast in the general election for the position for which he is a candidate, a runoff election for such position shall be called to be held fourteen ( 14) days following the date of the general election, said runoff election to be held between the two candidates who received the greatest number of votes cast in the general election for such position. In the event of a tie vote between two or more candidates with the second greatest number of votes in the general election, or in the event of a tie vote between the two candidates in a runoff election, the respective candidates so tied shall cast lots to determine who shall be, in the first instance, the successful candidate for the runoff election, or, in the second instance, the duly elected officer. In the event of a tie vote between three ( 3 ) or more candidates with the greatest number of votes or in the event of a tie vote between two ( 2 ) or more of the candidates with the second greatest number of votes in the general election for the position of Councilmember-at-large, the respective candidates so tied shall cast lots to determine who shall be, in the first instance, the duly elected officers or who shall be, in the second instance, the duly elected officer. All officers duly elected shall take office on the first Tuesday following the runoff election, if one is required; and if no run-off election is required, then all said officers shall take office on the first Tuesday following the general election. " Amendment No . 5 Sections 2 , 3 , 7 and 8 of Article I I I of the Charter of the City of Beaumont shall be amended as follows: Article III "Section 2 shall be amended by substituting the words ' six Councilmembers' in lieu of the words ' four councilmen' . Section 3 shall be amended by substiuting the words ' six Councilmembers' in lieu of the words ' four Councilmen' . The last sentence of Section 3 shall be deleted. Section 7 shall be amended by substituting the word ' three' in lieu of the word ' two' where it twice appears. Section 8 shall be amended by substituting the word ' four' in lieu of the word ' three' where it twice appears. " Amendment No. 6 Section 6 of Article IV is hereby amended to read as follows: The official ballot shall be prepared in accordance with law ." Amendment No . 7 If Proposition 1 found in Section 5 hereof is approved by the qualified voters at the election to be held August 13, 1983, section 2 of Article III of the Charter of the City of Beaumont shall be amended by adding the following sentence to read as follows: ( It is the intention of this ordinance that Proposition 2 , found in Section 5 hereof shall, if approved by the qualified voters, be effective only in the event that said Proposition 1 shall be approved by the qualified voters. ) "At the election held in 1984 under this Charter, as amended, the ward councilmembers shall be elected for a term of one ( 1 ) year and the Mayor and Councilmembers-at-large shall be elected for a term of two ( 2 ) years; thereafter, the Mayor and all Councilmembers shall be elected for two ( 2 ) year terms . " Section 3 . The special election hereby ordered shall be held under the provisions of the Charter of the City of Beaumont, Texas, and the Constitution and Laws of the State of Texas and the ordinances of the City of Beaumont, including this particular ordinance, and only qualified voters of and in the City of Beaumont shall be allowed to vote at said election, and each elector shall vote in the election precinct of his residence. Section 4 . The places for voting and the judges and officials at said election are set out in Exhibit "A" attached hereto and made a part hereof for all purposes. The presiding judges shall be authorized to select such clerks or other assistants provided by law , as may be deemed necessary; and said election shall be held in accordance with the provisions of law relating to elections for the submission of amendments to municipal charters, and the general laws of the State of Texas shall be observed insofar as they are applicable. Section 5 . The City Clerk is hereby directed to prepare the ballots for said election. On such ballots shall appear propositions corresponding to the proposed Charter amendments set forth above in Section 2 , with provision on such ballots permitting voters to vote "YES" OR "NO" on the propositions. Such propositions shall be as follows: Proposition No. 1 (Relating to number and term of the City Council and amending the method of election) Shall Section 5 of Article I of the Charter of the City of Beaumont be repealed and shall Section 2 of Article III and Sections 4 and 6 of Article IV of the Charter of the City of Beaumont be amended to provide for six (6 ) Councilmembers and a Mayor each of whom shall serve for two ( 2 ) year terms with four (4 ) Councilmembers to reside in designated wards, to be elected by a majority of the qualified voters who shall reside only within the boundaries of the designated wards, two ( 2 ) Councilmembers to be elected at-large by a plurality of the qualified voters of the City, and a Mayor who shall be elected at-large by a majority of the qualified voters of the City making a total of seven ( 7 ) persons to serve on the City Council; and further changing provisions of the Charter of the City of Beaumont relating to the total number of Councilmembers and the number of Councilmembers required for action in certain cases, by amending Sections 3 , 7 and 8 of Article III of the Charter of the City of Beaumont? L_�:] YES E NO Proposition No . 2 (Relating to the staggering of the terms of office of the City Council) If Proposition No. 1 above is approved by the qualified voters of the City, shall Section 2 of Article III of the Charter of the City of Beaumont be further amended to provide that the City Council shall be elected for staggered terms ; so that Section 2 of Article III of the Charter of the City of Beaumont will provide that at the election held in 1984, the ward Councilmembers shall be elected for a term of one ( 1 ) year and the Mayor and Councilmembers-at-large shall be elected for a term of two ( 2 ) years; thereafter, the Mayor and all Councilmembers shall be elected for two ( 2 ) year terms . E YES NO In addition to the above propositions amending the Charter of the City of Beaumont, the ballot shall contain the following propositions to read substantially as follows: Proposition No. 3 (Relating to the sale of Morgan Park) Proposed that 64 .8 acres, more or less, out of the Hezekiah Williams Survey , known as Morgan Park , shall be sold for cash. All monies acquired in said sale shall be used for the acquisition and improvement of parks for the City of Beaumont. FOR THE SALE El AGAINST THE SALE Proposition No. 4 (Relating to the sale of Spindletop Park) Proposed that 16 acres, more or less, out of the John A. Veatch Survey , known as Spindletop Park , shall be sold for cash. All monies acquired in said sale shall be used for the acquisition and improvement of parks for the City of Beaumont. FOR THE SALE Ll AGAINST THE SALE Section 6 . That an electronic voting system, as defined and described by Article 7 .15, Texas Election Code, shall be used for said election and the following are hereby appointed officers of said election to serve at the Central Counting Station, which is hereby established at the Jefferson County Mid-County Office Building: Manager of the Central Counting Station: Tom Lawrence Tabulation Supervisor: Raymond McInnis Presiding Judge for the Central Counting Station: Myrtle Corgey The Manager and Presiding Judge of the Central Counting Station shall appoint not more than four ( 4 ) clerks to serve at the Central Counting Station. The official ballot cards and ballot labels, respectively , for the election shall be prepared in accordance with the Texas Election Code. Absentee voting shall be conducted by a clerk for absentee voting, namely , Myrtle Corgey , the City Clerk , and the place at which the absentee voting shall be conducted is designated at the City Hall, Beaumont, Texas, which address is the mailing address to which absentee ballot applications and ballots voted by mail may be sent. Said clerk shall keep said office open for at least eight ( 8 ) hours, between 8 : 00 a.m. to 5 :00 p.m. , on each day for absentee voting which is not a Saturday, a Sunday, or an official State holiday; provided, however, except as authorized by Article 5 .05, Subdivision 3 (d) , Texas Election Code, said clerk shall not permit anyone to vote absentee by personal appearance on any day which is not a regular working day for the clerk' s office, and under no circumstances shall she permit anyone to vote absentee by personal appearance at any time when her office is not open to the public. Absentee votes by mail shall be counted by a special canvassing board consisting of a Presiding Judge and two clerks. E . A. Adams is hereby appointed Presiding Judge of the special canvassing board and he shall appoint the two clerks. Section 7 . A copy of this ordinance, both in the English language and in the Spanish language, signed by the Mayor of the City of Beaumont, Texas, and attested by the City Clerk of said City, shall constitute the notice ordering said election and the City Clerk is directed to cause a copy of this ordinance, signed by the Mayor and attested by her, to be posted at the City Hall in the City of Beaumont, Jefferson County, Texas, and at each of the polling places in each precinct of the City, said posting to be not less than twenty ( 20) days prior to said election, and to cause a copy of this ordinance to be published on the same day in each of two ( 2 ) successive weeks in some newspaper of general circulation in the City of Beaumont, said publication to be made in accordance wih the requirements of Article 1170, V.A .C .S . , Texas, the first such publication to be made not less than fourteen ( 14) days before the date of said election. Section 8 . If any one or more of the propositions approved by the voters at the election held pursuant to this ordinance, shall be held unconstitutional or invalid, for any reason, such unconstitutionalilty or invalidity shall not affect the validity of the remaining propositions. Section 9 . This ordinance shall be finally passed on the date of its enactment and shall take effect immediately upon its passage and signature by the Mayor. The City Clerk is hereby authorized to attest to same and to affix the seal of the City of Beaumont hereto. Section 10. The Charter amendments proposed herein, if approved by the qualified voters of the City of Beaumont, shall be effective for the general municipal election to be held in 1984 and thereafter.
