ENTITLED AN ORDINANCE AMENDING CHAPTER 6 ,
SECTION 6-21 OF THE CODE OF ORDINANCES TO
PROVIDE AN EXCEPTION FOR EMERGENCY EGRESS
WINDOWS IN BEDROOMS IN SECTION 1104.4 OF
THE STANDARD BUILDING CODE; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL; AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
That Chapter 6-21 of the Code of Ordinances of the City of
Beaumont is hereby amended to add an amendment to Section 1104 .4 of
the Standard Building Code to read as follows:
Section 1104.4--EMERGENCY EGRESS OPENINGS
Every sleeping room in one and two-family residences
shall have at least one operable window or exterior
door approved for emergency egress. The units must
be operable from the inside to a full clear opening
without the use of separate tools . Where windows
are provided as a means of egress, they shall have
a sill height of not more than forty-four (44)
inches above the floor.
All egress windows from sleeping rooms must have a
minimum net clear opening of five and seven-tenths
(5 .7 ) square feet. The minimum net clear opening
height dimension shall be twenty-four ( 24 ) inches.
The minimum net clear opening width dimension shall
be twenty ( 20) inches.
EXCEPTIONS : Grade floor windows may have a minimum
net clear opening of five ( 5 ) square feet and a
sill height of not more than forty-eight ( 48)
inches above the floor.
In bedrooms, a 310" x 310" or 210" x 610" standard
manufactured window may be used in place of a
window with the opening size and dimensions as
outlined herein.
Section 2 .
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be
invalid, such invalidity shall not affect the remaining portions of
this ordinance, and to such end the various portions and provisions
of this ordinance are declared to be severable.
Section 3 .
That all ordinances or parts of ordinances in conflict
herewith are repealed to the extent of the conflict only .
Section 4 .
That any person who violates any provision of this
ordinance shall , upon conviction, be punished as provided in Section
1-8 of the Code of Ordinances of Beaumont, Texas.
