ENTITLED AN ORDINANCE ISSUING A
SPECIFIC USE PERMIT TO ESTABLISH A
LANDSCAPING SERVICE AND RETAIL NURSERY
IN AN RM-H ( RESIDENTIAL MULTIPLE
DWELLING - HIGH DENSITY) DISTRICT.
WHEREAS, the Planning and Zoning Commission of the City of
Beaumont considered the issuance of a specific use permit to
establish a landscaping service and retail nursery in an RM-H
( Residential Multiple Dwelling - High Density) District on property
located at 8155-8255 Gladys and described as Lots 1-3 , Block 37 ,
Dowlen West, Unit XIX , Beaumont, Jefferson County, Texas to C-Quad,
Inc. , Leassee from owner, its legal representatives, successors , and
assigns for that certain property hereinafter described; and,
WHEREAS, the City Council is of the opinion that the
issuance of such specific use permit is in the best interest of the
City of Beaumont and its citizens, subject to the hereinafter
described conditions;
NOW , THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That all conditions necessary for issuance of a specific
use permit have been met and the specific use permit to establish a
landscaping service and retail nursery in an RM-H ( Residential
Multiple Dwelling - High Density) District on property located at
8155-8255 Gladys and described as Lots 1-3 , Block 37 , Dowlen West,
unit XIX, Beaumont, Jefferson County , Texas, in accordance with
Section 30-26 and Section 30-40 of the Code of Ordinances of the City
of Beaumont, as amended, be granted to C-Quad, Inc. , its legal
representatives, successors and assigns for that certain tract
described in Exhibit "A" attached hereto and made a part hereof for
all purposes.
Section 2 .
That the specific use permit herein granted is expressly
issued for and in accordance with each particular and detail of the
site plan attached hereto as Exhibit "B" and made a part hereof for
all purposes.
