HomeMy WebLinkAboutORD 82-131 ORDINANCE NO._Z!?-Z,�1 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING PROPERTY DESCRIBED AS 70 ACRES OUT OF THE DANIEL EASELEY SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AND PRESENTLY ZONED AR (AGRICULTURAL - RESIDENTIAL) DISTRICT AND RM-H (RESIDENTIAL MULTIPLE DWELLING - HIGH DENSITY) DISTRICT TO RS (RESIDENTIAL SINGLE FAMILY) DISTRICT BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1 . THAT Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-58 thereof, is hereby amended by changing the zoning classification from AR (Agricultural - Residential) District and RM-H (Residential Multiple Dwelling - High Density) District to RS (Residential Single Family ) District on property described as 70 acres out of the Daniel Easeley Survey beginning 3500 feet south of the intersection of State Highway 105 and Keith Road, Beaumont, Jefferson County, Texas, as shown on Exhibit "A" attached hereto and made a part hereof for all purposes, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2 . That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4 . All ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5 . Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. EASLEY LEAGUE, Jefferson County, Texas, said tract being out of and a part of that certain tract conveyed to John H. Walker by Mildred W. Arthur, et al, by deed dated January 30, 1960 and recorded in Volume 1205 at Page 182 of the Deed Records of Jefferson County, Texas, and being also all of Two (2) Tracts (called 35 acres each) conveyed to Mansard Homes Company by M. J. Conner by deed dated November 8, 1965 and recorded in Volume 1445 at Page 131 and Volume 1445 at Page 174 of the Deed Records of Jefferson County, Texas , said tract or parcel being more particularly described by metes and bounds as follows; COMMENCING at a point marking the Southwest corner of the said D. EASLEY LEAGUE, said corner being also in the North line of the A. HUSTON SURVEY, Abstract No. 33; THENCE North with the West line of the said D. EASLEY LEAGUE, a distance of 3 ,165 . 78 feet to a point; THENCE South 890 58 ' 30" East a distance of 24 . 70 .feet to an old One (1) inch pipe found in the East right-of-way line of Keith Road for the Northwest corner of the herein described tract and the POINT OF BEGINNING; THENCE continuing South 890 58 ' 30" East, with the North line of the herein described tract, a distance of 6 ,042 . 64 feet to a 3/4" iron rod found for the Northeast corner of the herein described tract, said iron rod being also in the Westerly right- of-way of the L. N. V. A: Canal; THENCE South 430 06 ' 27" West with the Easterly line of the herein described tract and the Westerly right-of-way line of the said L. N. V. A. Canal, a distance of 1 ,506 . 20 feet to a One (1) inch pipe found for the Southeast corner of the herein described tract; THENCE North 89° 59 ' 29" west with the Southern most South line of the herein described tract, a distance of 871.67 feet to a One (1) inch pipe found for a corner of the herein described tract; , THENCE North 00° 01 ' 52" East a distance of 732 .65 feet to a One (1) inch pipe found for an interior corner of the herein described tract; THENCE North 89° 58 ' 30" West parallel to the North line of the herein described tract a distance of 4 ,142 . 08 feet to a 5/8" iron rod set in the East right-of-way line of Keith Road for a corner of the herein described tract; THENCE North with the East right-of-way line of Keith Road a distance of 367. 69 feet to the :POINT OF BEGINNING" , containing 3 ,047, 857. 942 square feet or 69. 969 acres , more or less, of land. 11/19/82 e%J.
