ENTITLED AN ORDINANCE AMENDING SECTIONS 28-27, 28-283 28-31 AND 28-39 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO ESTABLISH REFUSE COLLECTION RATES AND DUMPING FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: THAT Section 28-27(b) (1-5(i) and (ii) ) , Section 28-28(b) , Section 28-31(a) and (c) , and Section 28-39 of the Code of Ordinances of the City of Beaumont be amended to read as follows : Section 28-27(b) (1-5(i) and (ii) ) : ( 1 ) Single-family residence, $7. 00; (2) Duplex apartment building, $7. 00/unit; (3) Garage apartment unit, $7. 00/unit; (4) Two (2) family units on one meter $14. 00; (5) (i) Where all containers are placed in the same location and the charge for each house, mobile home, unit or apartment shall be $7. 00; (ii) Where all containers are centrally located the charge for each house, mobile home, unit or apartment shall be $7. 00. Section 28-28(b) : Schedules: The rates set out in the following schedule are monthly charges for sanitation. service based on the number of containers as defined in Section 28-22: 2 Pickups 4 Pickups Containers Per Week Per Week 0 - 2 $ 8. 00 $16. 00 3 or more $ 2. 00 each in $ 4. 00 each in excess of 2 excess of 2 Section 28-31(a) : Public, business and commercial institutions will receive sanitation container system service for the removal of trash and garbage under the rates and rules hereinafter set forth, as routes for such service are established by the city. All institutions on hand service will be required to change to container service when they are of sufficient size, have a proper location and containers are available by the sanitation department. If the institution is not agreeable it has the option of: ( 1 ) having a private hauler with a valid permit; ( 2) taking out a hauling permit and hauling its own garbage. Under the sanitation container system service, the city will furnish a container or containers to be used in the collection and removal of trash and garbage. i In lieu of charges provided in other schedules of this article, the following monthly charge per container, based upon container size, and number of collections per week , are the charges for such service: Collections Container Size Per Week Rate Two cubic yards 1 $ 32.00 2 48. 00 3 68. 00 4 88.00 5 108.00 6 128.00 Four cubic yards 1 42. 00 2 64. 00 3 92. 00 4 120. 00 5 148. 00 6 176. 00 Six cubic yards 1 55.00 2 90.00 3 125.00 4 160. 00 5 1.95. 00 6 230.00 Eight cubic yards 1 65. 00 2 105.00 3 150. 00 4 195. 00 5 240. 00 6 285. 00 Section 28-31(c) : When the container smallest in size will adequately and completely serve several adjacent business institutions, then they may be required to use the same container and pay a pro rata part of the charge, determined according to the approximate quantity of space used. The minimum charge for each customer when a container is shared is ten dollars ($10.00) , but in no case shall the total charge be less than for the same container serving one customer. The container service will be the complete service for all trash and garbage on the premises. Section 28-39(a) : a. Loose and non-compacted materials : ( 1) Small vehicles ( 1-3 cu. yd. capacity) $12/month (2) Medium vehicles ( 4-7 cu. yd. capacity) $24/month (3) Large vehicles (8-15 cu. yd. capacity) $ 4/Toad (4) Extra Large Vehicles 16-20 cu. yd. capacity $ 8/load 30 cu. yd. capacity $12/load 2 - Section 28-39(b) : b. Compacted Materials : (1) 20 cu. yds. compacted $30/load (2) 30 cu. yds, compacted $45/load (3) 40 cu. yds. compacted $60/load Section 1 . That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 2. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. Section 3.
