ENTITLED AN ORDINANCE AUTHORIZING DESTRUCTION OF
MUNICIPAL COURT COMPLAINTS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL.
WHEREAS, Article 6574c , Vernon' s Texas Civil Statutes
Annotated, authorizes the destruction of original public records
which are determined worthless by the governing body of an
incorporated city; and,
WHEREAS, notice of the proposed destruction or disposition
of original public records must first be given to the State Librarian
or State Archivist; and,
WHEREAS, the City Council of the City of Beaumont has
determined that Municipal Court complaints on file more than two (2)
years are worthless and should be destroyed;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMOIJT:
Section 1 .
THAT the City Clerk be, and she is hereby, authorized to destroy
Municipal Court complaints which have been on file more than two (2)
years at the time of destruction after giving notice to the State
Librarian or State Archivist, as required by Article 6574c, Vernon' s
Texas Civil Statutes Annotated.
Section 2 .
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be
invalid, such invalidity shall not affect the remaining portions of
this ordinance, and to such end the various portions and provisions
of this ordinance are declared to be severable.
Section 3.
All ordinances or parts of ordinances in conflict herewith
are repealed to the extent of the conflict only.
