ENTITLED AN ORDINANCE AMENDING CHAPTER 29 OF THE
CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS
BY AMENDING SECTION 29-79(7) RELATING TO WINCH
AND BOOM REQUIREMENTS FOR WRECKERS; PROVIDING FOR
REPEAL; PROVIDING FOR SEVERABILITY AND PROVIDING
A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1 .
THAT Chapter 29 of the Code of Ordinances of the City of
Beaumont be, and the same is hereby, amended by amending Section
29-79(7) to read as follows :
(7) Winch and Boom.
Such winch being a power-operated winch line and
boom with a factory rated lifting capacity ( or a
tested capacity) of not less than five thousand
(5,000) pounds, single line capacity in a boom not
less than five (5) feet in length; winch operating
controls must be operable from either side of the
truck and from inside the cab. The winch and boom
requirements contained herein shall not apply to
an auto-loading wrecker with a hydraulically-
operated bed.
Section 2.
That if any section, subsection, sentence, clause or phrase
of this ordinance, or the application of same to a particular set of
persons or circumstances, should for any reason be held to be
invalid, such invalidity shall not affect the remaining portions of
this ordinance, and to such end the various portions and provisions
of this ordinance are declared to be severable.
Section 3.
All ordinances or parts of ordinances in conflict herewith
are repealed to the extent of the conflict only.
Section 4.
Any person who violates any provision of this ordinance
shall, upon conviction, be punished as provided in Section 1-8 of the
Code of Ordinances of Beaumont, Texas.
